As approved above, the industry was issued show cause notice for refusal of consent under Water Act, 1974 with hearing before SEE, ZO-2, Ludhiana. The hearing was held on 15-02-2018. Sh. Dharampal, Proprietor attended the hearing. The proceedings are as under:-
At the outset of the hearing, Environmental Engineer, Zonal Office-2, Ludhiana informed that the industry is engaged in electroplating of cycle parts on job basis. The industry was granted consent of the Board under Water Act, 1974 along with restoration of electric connection, which are valid upto 28-02-2018 with special condition that the industry will obtain an exemption certificate from the Director of Factories w.r.t obtaining of approval of site from SCA-cum-SAC as required under the Factories Act, 1948, within 2 months. Further action regarding the requirement/non-requirement of approval of site from SCA-cum-SAC will be taken on the receipt of report of Director of Factories regarding the above exemption.
The industry has now applied for renewal of consent to operate under Water Act 1974. The application of the industry was examined and it was observed that the industry has not submitted the exemption letter from the Director of Factories w.r.t obtaining of approval of site from SCA-cum-SAC as required under the Factories Act, 1948. The industry has so far failed to obtain the letter in last 5 months.
Show cause notice for refusal of consent to operate under Water Act, 1974 was issued with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 15-02-2018.
Sh. Dharampal, Proprietor of the industry attended the hearing and submitted that they have less than 10 workers and already had applied for obtaining exemption vis-à-vis requirement of approval of site from SCA-cum-SAC in the office of Deputy Director of Factories, Ludhiana. He assured to submit the permission/exemption within one week.
After hearing the officers of the Board and the representative of the industry, the Senior Environmental Engineer, Zonal Office-2, Ludhiana decided as under:-
1) The industry shall submit the exemption letter from the Deputy Director of Factories, Ludhiana vis-à-vis requirement of approval of site from SCA-cum-SAC as required under the Factories Act, 1948, within 7 days.
2) Environmental Engineer, Regional Office-3, Ludhiana to process the application further accordingly as per the time schedule allowed.
The proceedings of the hearing are added herewith for the confirmation and approval by the Competent Authority, so as to convey the same to all the concerned for necessary compliance please.
