File Note: Subject: Application for obtaining renewal of ‘Consent to operate’ already granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 - M/s Vinod Kumar (Contractor), Village Sahauran, Kharar, SAS Nagar. The subject cited industry was granted consent to operate of the Board under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2016/4644856 dated 28.11.2016 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2016/4644838 dated 28.11.2016, both valid upto 31.12.2017, for operation of hot mix plant of capacity 50 TPH. Now, the industry has applied for obtaining renewal of the ‘consent to operate’ granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, along with documents such as compliance of conditions of the previously granted consents, latest CA certificate, undertaking etc. The industry had earlier deposited Rs. 15,000/- under each Act, vide R.no. 69/3871 dated 04.09.2014 and has now deposited Rs. 9000/- under each Act, vide R. No. 63/4611 dated 02.02.2018, on the account of consent fee and the fee deposited by the industry is adequate upto 30.09.2023. It is added here that as per categorization of industries issued by the CPCB, “Hot mix plants” are covered under ‘Orange category’ (at S.No. 39 and code 2037). And, as per the office order dated 02.02.2016, issued by the Board, the green and orange category of industries are to be granted renewal of consents under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without visiting the site of the industry. Since the project falls under ‘Orange category’, as such, the same was not visited to verify the compliance of the conditions of the consent granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974. The site of the industry shall be visited in due course of time. It is added here that along with the online application from, the industry has submitted an undertaking to the effect that they are complying with all the provisions of the Water Act, 1974 and Air Act, 1981. The undertaking submitted by the industry is as under: The industry has also submitted a copy of the stack emission sampling carried out by M/s Chandigarh Pollution testing laboratory on 14.02.2018 and as per the analysis results, the concentration of Particulate Matter is 89.4 mg/Nm3, which is within the prescribed standards (i.e. 150 mg/Nm3). As such, the industry is complying with the standards as prescribed by the Board. Further, the industry has submitted a copy of the lease deed dated 21.02.2018, executed between Smt. Narinder Kaur and Sh. Vinod Kumar. The said lease deed is valid upto 31.12.2025; In view of above, if may approved, the industry may be granted extension in the validity of the consent to operate of the Board already granted to it under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, upto 30.09.2022, along with suitable conditions.
