Subject: Show cause notice for refusal of consent under the Water (Prevention & Control of Pollution) Act, 1974.
Whereas it is obligatory on the part of hospital to obtain the 'consent to operate' of the Board u/s 25/26 of the Water (Prevention & Control of Pollution) Act 1974 as amended in 1988, for discharge of effluent from its premises and to operate an outlet.
And whereas, it is mandatory on the part of hospital to install proper and adequate Water Pollution Control Device so that the concentration of various pollutants conforms to the effluent standards prescribed by the Board.
And whereas, the hospital has applied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 through OCMMS.
And whereas, the hospital was visited by AEE on 09.02.2018 and observed as under:-
1) During visit, the hospital was in operation and is having bed capacity of 70 beds. However, during visit, only 50% occupancy was there.
2) The HCF is provided with colour coded bins along with bags for the segregation of bio-medical waste of different categories and same are provided at each generation point such as General Wards, Operation Theater & Lab.
3) The HCF has constructed one common storage room for bio medical waste provided with lock and key arrangements.
4) The hospital has provided hypochloride solution at lab, operation theater.
5) The domestic effluent and effluent after pre- treatment from lab, operation theater is discharged into M.C. Sewer.
6) The HCF has installed ETP for the treatment of effluent generated from the hospital. During visit, one effluent sample was collected from the outlet of the ETP and as per analysis results the conc of various parameters is as follows:- pH.7.7 ,BOD. 100 .COD. 316 ,TSS.152 - TDS. - 810,Oil &grease -4.0. ,BIOASSAY 0%.and various parameters are beyond limits for discharge into sewer by HCF. The treated effluent is discharged into M.C. Sewer.
And whereas, the hospital is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974.
And whereas, the matter has been considered by the Competent Authority and it has been decided to issue show cause notice for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974, with an opportunity of show cause notice.
As such, the project proponent is hereby given an opportunity, to file objections, if any, within 15 days, as to why the proposed action be taken, failing which it will be presumed that the hospital has nothing to say and the Board shall go ahead, to take proposed action for refused the consent to operate under Water (Prevention & Control of Pollution) Act, 1974, without giving any further notice/ opportunity.

A copy of the above is forwarded to the Environmental Engineer, Punjab Pollution Control Board, Regional Office, Hoshiarpur for necessary action and submit compliance report after 15-days.
