It is submitted that earlier the Brick kiln was granted consent to operate under Air Act, 1981 vide consent no. LDH-II/2003/2018/F-137 dated 22.09.2003 valid upto 05.02.2018 for manufacturing of bricks/tiles @ 10 Lac/round.
Now, the brick kiln has applied for renewal of consent under Air Act, 1981 through OCMMS on 13.03.2018.
As per the Board’s office order no. CEE/HQ/F. No. 957/2016/59, consent to operate for green and orange category industries may be given auto renewal within 7 days without making a visit to the industry.
The brick kiln has submitted the copy of letter of DTP, Ludhiana Letter No. 2348/DTP(L) B-21 dated 02.08.2013 regarding land use pattern of the site, which is reproduced as under:-
" ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਤੇ ਹਵਾਲੇ ਅਧੀਨ ਪ੍ਰਤੀਬੇਨਤੀ ਦੇ ਸਬੰਧ ਵਿਚ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਆਪ ਵੱਲੋਂ ਨੱਥੀ ਦਸਤਾਵੇਜਾਂ ਅਨੁਸਾਰ ਪਿੰਡ ਜੋਧਾਂ ਜਿਲਾ ਲੁਧਿਆਣਾ ਵਿਖੇ ਖਸਰਾ ਨੰ: 10//24/1,23/2/1,17/2,18/1,24/2,24//3/2, 8/1/1, ਕੁਲ ਰਕਬਾ 16 ਕਨਾਲ 0 ਮਰਲੇ ਵਿੱਚ ਭੱਠਾ ਜੁਲਾਈ, 2007 ਤੋਂ ਪਹਿਲਾਂ ਦਾ ਚੱਲ ਰਿਹਾ ਹੈ। ਇਸ ਭੱਠੇ ਦੀ ਸਾਈਟ ਮਾਸਟਰ ਪਲੈਨ, ਲੁਧਿਆਣਾ (2007-2021) ਦੀਆਂ ਤਜਵੀਜ਼ਾਂ ਅਨੁਸਾਰ ਰਿਹਾਇਸ਼ੀ ਜ਼ੋਨ (ਆਰ ਡੀ-3) ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਇਹ ਸਾਈਟ ਨਾਨ ਕੰਨਫਰਮਿੰਗ ਜ਼ੋਨ ਵਿੱਚ ਆ ਗਈ ਹੈ। ਇਸ ਲਈ ਪੰਜਾਬ ਰਿਜ਼ਨਲ ਐਂਡ ਟਾਊਨ ਪਲੈਨਿੰਗ ਐਂਡ ਡਿਵੈਲਪਮੈਂਟ ਐਕਟ, 1995 ਸੋਧ 2006 ਦੀ ਧਾਰਾ 79 ਅਧੀਨ ਇਸ ਸਾਈਟ ਵਿੱਚ ਸਮਰਥ ਅਧਿਕਾਰੀ ਦੀ ਪ੍ਰਵਾਨਗੀ ਨਾਲ ਨੌਟੀਫਿਕੇਸ਼ਨ ਦੀ ਮਿਤੀ ਤੋਂ 10 ਸਾਲ ਤੱਕ ਇਹ ਭੱਠਾ ਚਾਲੂ ਰੱਖਿਆ ਜਾ ਸਕਦਾ ਹੈ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਸਾਈਟ ਦੇ ਅੱਗੇ ਜਾਂਦੇ 22 ਫੁੱਟ ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਨੂੰ ਮਾਸਟਰ ਪਲੈਨ, ਲੁਧਿਆਣਾ (2007-2021) ਦੀਆਂ ਤਜਵੀਜ਼ਾਂ ਅਨੁਸਾਰ 150 ਫੁੱਟ ਚੌੜੀ ਸੈਕਟਰ ਰੋਡ ਵੱਜ਼ੋਂ ਤਜਵੀਜ਼ ਕੀਤਾ ਗਿਆ ਹੈ। ਇਸ ਲਈ ਆਪ ਆਪਣੀ ਜਗ੍ਹਾਂ ਵਿੱਚੋਂ 64 ਫੁੱਟ ਜਗ੍ਹਾਂ ਛੱਡਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਂਗੇ।"
As per above letter the Brick Killn now falls in residential Zone and as per Govt. of Punjab, Department of Legal and Legislative Affairs, Punjab Notification dated 21st October, 2016 the time period for shifting of existing industries has been extended from Ten years to fifteen years from the date of notification of Master Plan, the relevant extract of the said notification is as under:-
“ In the Punjab Regional and Town Planning and Development Act, 1995, in section 79, in the proviso thereunder, for the words “ten years”, the words “fifteen years” shall be substituted.” (Copy of said notification is pasted below).
Also, as per Board’s office order no. 346 dated 01.08.2016, the MoEF has constituted DIEAA & DEAS for the grant of Environmental Clearance to the Brick kiln owners for mining of brick earth at Distt. Head Quarters instead of at one place by the SEIAA/SEAC. And Environmental Clearance for mining of brick earth will not be a pre-requisite for the grant of consent to operate to the brick kilns. The consent to operate shall be issued to the brick kilns subject to the condition that the BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of Bricks.
As per the Board’s office order no. CEE/HQ/F. No. 957/2016/59, consent to operate for green and orange category Head Office, Patiala Circular no. SEE(HQ-2)/2017/1043 dated 08.11.2017, the consents to operate to the Brick Kilns shall be renewed upto 31.03.2019 with the condition that these brick kilns shall adopt the Induced Draft technology by such time. The brick kilns which have already adopted the Induced draft technology with Zig-Zag firing and has obtained completion cum adequacy certificate to this effect from the PSCST, the consent to operate shall be issued for a period of five years, which would culminate on 30th of September.
In view of the above, it is recommended that the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2019 to the brick kiln with usual conditions and special condition that:-
(1) The Brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of Bricks.
(2) The Brick Kiln will not manufacture of Bricks/Tiles @ 10 Lacs/Round.
(3) The Brick kiln shall adopt the Induced Draft technology by 31.03.2019.
(4) The Brick kiln will submit revised lease deed one month prior to the expiry of the same. If the brick kiln fails to submit the revised/extended lease deed one month prior to the expiry of the same, then the earlier consent fee deposited by the BKO will stand forfeited and the brick kiln will have to apply fresh consent alongwith the requisite consent fee.
(5) The brick kiln will not start any mining activity viz-a viz the operation of this brick kiln is concerned, without obtaining Environmental Clearance from the Competent Authority prescribed for said purpose.
(6) The brick kiln shall also comply with the Mines & Mineral (Development & Regulation) Act, 1957 and Punjab Minor Mineral (Amendment) Rules, 2013 and THE PUNJAB REGIONAL AND TOWN PLANNING AND DEVELOPMENT (AMENDMENT) ACT, 2016 as amended from time to time.
