Subject: Show cause notice for refusal of consent under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974.
Whereas, it is mandatory on the part of industry to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of effluent/emissions from its industrial premises and to operate an industrial plant.
And whereas it is also mandatory on the part of industry to install proper and adequate effluent /air pollution control devices so that the concentration of various pollutants conforms to the effluent/ emission standards prescribed by the Board.
And whereas, the industry was established without NOC of the Board. The industry was engaged in manufacturing patta from wood with the help of band saw and peeling machine.
And whereas, the industry has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 &Air (Prevention & Control of Pollution) Act, 1981 online through OCMMS.
And whereas, The industry was visited by the AEE of Regional office on 02.02.2018 and it was observed that
1) The industry was in operation during visit.
2) The industry has submitted DFO license no. 139 dated 16.03.2019 for 3 no vertical band saw of size 42" (2no)and 36" and 2 no peeling machine of size 40" and 56" at site.
3) The industry has installed 1 no vertical band saw of size 42", 2 no band saws has yet to be install by the project proponent. The 2 no peeling machines of size 40" and 56" are available at site.
4) The industry has submitted the approve building plan from the competent person under factory act.
5) The industry has 01 DG Set with canopy.
6) The industry has provided septic tank for the collection of domestic effluent which is further discharge onto land for plantation. As the industry is yet to install 2 no band saws and peeling machines.
And whereas, show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act 1974 as amended in 1988 and Air (Prevention & Control of Pollution) Act, 1981, as amended in 1987 was issued to industry for reply after 15-days. The industry has submitted reply for the show cause notice that the industry has obtained license from Forest Department for 03 no saw mill and 02 no peeling machine, but they have installed 02 no peeling machine and 01 no saw mill as per site condition. The industry has requested for consent to operate for 02 no peeling machine and 01 no saw mill only. The industry will take permission from the Board for the operation for 02 no band saws in near future. The industry has installed 1 no vertical band saw of size 42", 2 no band saws has yet to be install by the project proponent. The 2 no peeling machines of size 40" and 56" are available at site.

And whereas, the industry was visited by AEE of Regional office on 22.03.2018 and observed that the industry has installed 02 no peeling machine and 01 no saw mill at site. The domestic effluent was discharged onto land for plantation after septic tank.
And whereas, the industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
And whereas, it has now been proposed to refuse the consent to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity.
Before, the above action is taken, you are, hereby given an opportunity of personal hearing, to file objections, if any, on the proposed action before the Senior Environmental Engineer, in his office at Zonal Office, Near PSIEC Water Tank, Focal Point, Jalandhar on 05/04/2018 at 11.00 AM failing which it will be presumed that the industry has nothing to say and the Board shall go ahead to take proposed action under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, without giving any further notice / opportunity.

A copy of the above is forwarded to the Environmental Engineer, Punjab Pollution Control Board, Regional Office, Hoshiarpur necessary action. He is requested to inform the industry regarding the hearing well before the date of hearing.
