The industry was granted consent to establish/NOC vide no. CTE/Fresh/MNS/2017/6261114 dt. 06.10.2017 for establishment of rice sheller unit of capacity 2 TPH of raw rice /sorted rice without dryer, subject to the conditions mentioned therein.
Notice for violation of the provisions of the Water Act, 1974 and Air Act, 1981 was issued to the industry vide this office regd. letter no. 4729 dt. 02.11.2017 to explain its position in writing, within a period of 15 days. However, the industry failed to submit any reply.
Accordingly, show cause notice for violations of provisions of the Water Act, 1974 and Air Act, 1981 was issued to the industry with an opportunity of personal hearing before the Environmental Engineer on 07.03.2018 vide this office regd. Letter no. 910 dated 26.02.2018 as the industry has failed to apply for consent to operate under the Water Act, 1974 and Air Act, 1981 in this office till that date.
Sh. Gagandeep Singh, Partner of the industry attended the said hearing and assured to apply for consent to operate under the Water Act, 1974 and Air Act, 1981 within 7 days.
Accordingly, proceedings of the hearing were issued to the industry vide this office letter no. 2501 dated 14.03.2018.
Accordingly, the industry applied for fresh consents to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS on 17.03.2018 for operation of rice sheller unit of capacity 2 TPH of raw rice /sorted rice without dryer under the Orange category as per the prevailing policy.
The industry was visited by undersigned on 06.04.2018 and it was observed as under –
• The industry was not in operation as the industry has completed the milling of paddy for the season 2017-18.
• The industry has installed cyclone separator as an APCD with shelling section to contain the process emissions, however all the dust emitting points in the shelling section were not connected to this APCD.
• The industry has not provided adequate sampling arrangements with this cyclone separator.
• The industry has not provided brick paving at movement area of vehicles, within its premises to prevent the generation of dust emissions.
• The industry has provided brick wall of 10’ height around husk discharge / storage area, but a wind screen of MS of 5’ height has not been provided above the said wall.
• The industry has not provided any septic tank for treatment of domestic effluent from labour quarters and office premises. The untreated domestic effluent is discharged into a soakage pit.
• The industry has not made adequate plantation along its boundary wall.
The industry is not complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
Keeping in view of above, it is recommended that show cause notice may be issued to the industry for refusal of consent to operate applied by the industry under the Water Act, 1974 and Air Act, 1981 due to reasons mentioned above.
