Subject: Show cause notice for refusal of consent under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974.
Whereas, it is mandatory on the part of industry to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of effluent/emissions from its industrial premises and to operate an industrial plant.
And whereas it is also mandatory on the part of industry to install proper and adequate effluent /air pollution control devices so that the concentration of various pollutants conforms to the effluent/ emission standards prescribed by the Board.
And whereas, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS of the Board.
And whereas, the industry was visited by the AEE on 22.03.2018 and it was observed that the industry was in operation during visit and was engaged in the process of manufacturing of transmission belt at site. The industry has installed one press, one calendar machine one kneader machine, and two mixture at site. The industry has installed one wood fired baby boiler with stack and same was in operation. Wood was using as fuel in its baby boiler during visit. The industry was generating only domestic effluent at site and same was discharging into sewer. The industry has uploaded the area classification issued by ATP MC Jalandhar vide letter no. 3185 dated 29.01.2018 and as per certificate the site of the industry falls in general industrial zone as per Master Plan (2009-31). The industry has uploaded the CA certificate uploaded does not contain the cost of land, building and other fixed Assets.
And whereas, the industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
And whereas, the matter has been considered by the Competent Authority and it has been decided to issue show cause notice for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with an opportunity of show cause notice.
As such, the industry is hereby given an opportunity, to file objections, if any, within 15 days, as to why the proposed action be taken, failing which it will be presumed that the industry has nothing to say and the Board shall go ahead, to take proposed action for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without giving any further notice / opportunity.
