File Note: It is intimated that, the industry has applied for ‘Consent to Operate’ under Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 along with documents through OCMMS and requested to restore the power connection disconnected by the PSPCL authority. According, the site of the industry was visited by Er. Malkit Singh, JEE of this office on 09.04.2018 and observed that:- 1. The industry was in operation during the visit. 2. The industry has agreement with M/s JBR Technology Pvt. Ltd., Unit-II, Kohara, Ludhiana @ 2000 Ltr/M for lifting its spent acid generating from acid pickling section. 3. The industry has provided water meter on the fresh supply of water leading to acid pickling section and its reading was 5.56 Kl during the visit. 4. The industry has installed underground syntax tank of capacity 1000 litre and same was empty during the visit. 5. The industry has maintaining the record of quantity of Spent acid generated & lifted by Re-processor. 6. Only domestic effluent is discharged into sewer. It is pertinent to mention that Board vide no. 47236-261 dated 22-12-2017 has forwarded the directions issued by CPCB u/s 18(1)b of Water Act, 1974 and Air Act, 1981. As per these directions, SPCB/PCC shall ensure that while issuing NOC/consent/Renewal under Water Act, 1974 and Air Act, 1981, details on onsite emergency plan, safety reports and safety audit reports, be compulsorily sought from occupier, industry or installation. These directions cannot be complied with immediate effect. Since, this exercise may take some time and till such time, the online consent application cannot be kept pending which is being regularly monitored under RTS Act and the OCMMS system of the Board is even being monitored through the dash board in the office of Hon’ble Chief Minister. In view of above, it is recommended that the short term consents for a period of six months may be issued to the industry with special condition that the industry shall comply with the directions issued by CPCB u/s 18(1)b of Water Act, 1974 and Air Act, 1981 in the matter of manufacturing, storing and import of hazardous chemical Rules, 1989 as mentioned in the Board letter no. 47236-261 dated 22-12-2017. Accordingly, the industry shall submit the details on onside emergency plan, safety reports and safety audit reports in accordance with the manufacture, storage and import of hazardous chemical rules, 1989, in case the industry or installation handling hazardous chemicals quantity equal to or more than the threshold quantity specified in the said rules. The industry shall ensure complete compliance of the provisions of hazardous chemical Rules, 1989 (as amended from time to time). Keeping in view of the above, it is recommended that consent to operate under Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 may be granted to the industry upto 30.08.2018 with usual conditions in compliance of Master Plan, Ludhiana.
