It is submitted that the subject cited industry is an ERW Pipe Plant and was granted consent to operate under Green Category under the Water Act, 1974 vide no. FGS/WPC/07 and under the Air Act, 1981 vide no. FGS/APC/07 dated 4/6/2007, both valid upto 30/6/2022 for the manufacturing of ERW Conduit Pipes @ 45 TPD.
Now, the industry has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 to increase its production capacity from 45 T/day to 90 T/day of ERW Conduit Pipes through OCMMS with requisite documents. The industry has also deposited Rs. 53000/- each vide R. no. 58/4901 and 59/4901 dated 3/4/2018 as Water and Air Consent fee against the fixed assets of Rs. 177.08 Lacs as on 15/3/2018 as per CA Certificate dated 20/3/2018. The consent fees are adequate upto 31/3/2028 as per Board's Office Order dated 18/7/2013. The industry has also deposited Rs. 5800/- vide Rs. No. 57/4901 dated 3/4/2018, which is adequqate.
It is further intimated that as per application form submitted by the industry, there is no generation of trade effluent as whole of the water used for the cooling purposes is being re-circulated. There is only generation of domestic effluent which is being discharged onto land for plantation after septic tank. The industry has not installed any DG set as per mentioned in the application form.
Further, as per the guidelines issued by Central Ground Water Authority (CGWA), Amloh Block of Fatehgarh Sahib District falls in the list of notified area. As this industry does not fall in the list of water intensive industries and only require water for drinking purposes. However, the industry has proposed to utilize water from PSIEC Supply for its operations. Furthermore, the Board has also clarified vide SEE (HQ-1) Head Office letter no. 7956-97 dated 9/3/2018, the operative part of this letter is as under:
It has been decided that the Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the authorities concerned as notified by the Cental Ground Water Authority. However, aforesaid kclearnace shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.
It is further submitted that as per Board Office Order no. 244 dated 03/06/2013, the powers have been delegated to the Environmental Engineers of the Regional Offices of the Punjab Pollution Control Board to grant 'consent to establish' / operate under the Water Act, 1974 and Air Act, 1981 for Cold Storage irrespective of its capacity.
Further, the industry is complying with the conditions of the consents granted to it under the Water Act, 1974 and the Air Act, 1981.
In view of the above, if approved, the consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be renewed upto 31/12/2027 (under Green Category) with suitable conditions alongwith special conditon that the industry will comply with the CGWA guidelines.
