The direction under section 33-A of the under Water (Prevention & Control of Pollution) Act,1974 were confirmed against the industry vide No.209, Dt.11.01.2014 for sealing of wet process. One nickel plant One Chrome plant one no. hydro machine and one no. caustic dhol has been sealed on 11-01-2014.
Now, the industry has applied the consent of the Board under Water (Prevention & Control of Pollution) Act,1974 alongwith SSI Certificate as proof regarding its date of commissioning alongwith balance consent fees under Water (Prevention & Control of Pollution) Act,1974 with request for de sealing of the above said machinery.
The industry has submitted an undertaking to this office that the industry is operation prior July, 2007 before the notification of the master plan, Ludhiana and will submit the certificate within 03 months from date of this undertaking from competent authority for continuance of the industry at its present site for further period (to be determined by competent authority)
The site of the industry was visited by me of this office on 20.01.2014 & it was observed that:-
1. The industry has made an agreement on 30.07.2012 with M/s JBR Tech. Pvt. Ltd., C.E.T.P, for lifting of effluent @ 2000 Ltr/Month which is valid upto 31.05.2015.
2. The industry has provided water meter at the source of water supply attached to plating section.
3. The industry has provided storage tank of Syntax tank of 500 Ltr capacities before lifting effluent to operator.
4. The industry exists in non designated area.
As per latest policy of the Board which is conveyed vide Head office letter no. EE(Mega)/2013/19650-19761 dated 30.04.2013 , the industries to be set up in areas other than the area such as designated/approved areas such as industrial Area/industrial Estate/Industrial Focal Point /approved Industrial Park. Industrial Zone of the Master plan, site clearance u/s 41 of the factories Act, 1948 will be necessary before grant of consent to establish/ authorization by the Board page no. 3 para no .2. but this industry exist in non designated area and has failed to obtain SAC.
The industry has not obtained NOC of the Board for red category unit, however, deposited NOC regularization fees and has taken adequate and appropriate pollution control measures. The industry exists in non designated area and claimed the commissioning of red category unit prior approval of master plan Ludhiana (2007-2021). The industry has submitted the certificate of ATP, Municipal Corporation Ludhiana vide there no. 47 Dt.28-06-2012 that the site falls in industrial mix zone. But failed to get the certificate from competent authority in the light of Zonal office Letter no 5979 dated 06.09.2013
In the view of undertaking submitted by industry, It is recommended that:-
1. The Direction under section 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued for de sealing of the machinery
2. The Consent under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for three months with following conditions
That the industry shall submit the permission within three months from competent authority for continuance of operation of the industry at its present site.
The Industry shall obtained the SAC clearance during this period.
