It is submitted that the subject cited industry is an ERW Pipe Plant and was granted consent to operate under Green Category under the Water Act, 1974 vide no. RO/FGS/WPC/2010/V-353 and under the Air Act, 1981 vide no. RO/FGS/APC/2010/V-349 dated 22/10/2010, both valid upto 21/10/2020 for the manufacturing of ERW Pipes @ 40 TPD under the name of M/s Aditya Pipes and Strips Pvt. Ltd. The industry could not operate its unit due to the market conditions and was lying closed. Thereafter, the industry has been purchased by M/s D.R. Industries on 10/7/2017 from the ICICI Bank authorities with whom the industry was lying mortgaged.
Now, the industry has applied for fresh consent to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS with requisite documents under the name of M/s D.R. Industries. The industry has also deposited Rs. 26500/- each vide R. no. 67/4901 and no. 68/4901 dated 3/4/2018 as Water and Air Consent fee against the fixed assets of Rs. 171.66 Lacs as on 13/12/2017 as per CA Certificate dated 28/12/2018. The consent fees are adequate upto 31/12/2022 (as the industry has mentioned in the application form, the industry started its operations of the unit in the month of December, 2017 and the industry has also enclosed the copy of Electricity Bill as proof of commissioning) as per Board's Office Order dated 18/7/2013.
It is submitted that the industry was visited by the undersigned of this office on 5/4/2018. During the visit, it was observed that;
1. The industry is a pipe plant and was in operation.
2. There is no generation of trade effluent as whole of the water used for the cooling purposes is being re-circulated.
3. There is only generation of domestic effluent which is being discharged onto land for plantation after passing through septic tank.
4. There is no generation of any air emissions and has also not installed any DG set inside the industrial premises.
Further, as per the guidelines issued by Central Ground Water Authority (CGWA), Amloh Block of Fatehgarh Sahib District falls in the list of notified area. As this industry does not fall in the list of water intensive industries and only require water for drinking purposes. Furthermore, the Board has also clarified vide SEE (HQ-1) Head Office letter no. 7956-97 dated 9/3/2018, the operative part of this letter is as under:
It has been decided that the Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the authorities concerned as notified by the Cental Ground Water Authority. However, aforesaid kclearnace shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.
In view of the above, if approved, the consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted upto 31/12/2022 (under Green Category) with suitable conditions alongwith special conditon that the industry will comply with the CGWA guidelines.
