Proceedings of the personal hearing given on 16/4/2018 by the Chairman of the Board to M/s Gillco Developers & Builders Pvt. Ltd., (Project : Gillco Towers), Kharar, Sector 127, Distt. SAS Nagar u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981.
The following were present:

Senior Environmental Engineer, Zonal Office-I, Patiala brought out that the project proponent has obtained environmental clearance vide no. SEIAA/2009/26718 dated 11/8/2009 for the development of group housing in an area of 37,659.09 sqm (9.03 acre) having built up area 70,138.838 sqm with the following main conditions that:
1. The treated wastewater @ 118 KLD shall be used for flushing purposes, @ 13 KLD for horticulture purposes and remaining shall be discharged into sewer.
2. The project proponent shall use in-vessel bio-compost technique for composting the organic waste.
The project proponent was afforded an opportunity of personal hearing by the Chairman of the Board on 17/12/2015. During hearing, Sh. Paramjit Singh, Sr. General Manager (Technical & Administration) of the project stated that they have obtained environmental clearance under the provisions of the EIA Notification dated 14/9/2006 and NOC as well as 'consent to operate' under the Water Act, 1974. But he could produce any supporting evidence in this regard. After hearing, amongst other decisions, it was decided that the project proponent shall supply copy of approved layout plan, environmental clearance, NOC and 'consent to operate', by 21/12/2015. But the project proponent failed to submit any reply w.r.t. decision of the hearing.
The representative of the project proponent has given wrong statement during hearing on 17/12/2015 to the effect that they have obtained NOC from pollution angle as well as 'consent to operate' under the Water Act, 1974.
The project proponent has now applied for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981.
From the perusal of documents uploaded online by the project proponent, it has been observed that the project proponent has not submitted any documentary proof regarding date of start of construction as well as completion of project.
The project site was visited by AEE, RO, SAS Nagar on 5/3/2018 and it was observed that:
a) The project proponent has completed the construction of 395 flats, out of which 50-60% flats have been occupied. But the project proponent has not yet started the construction of EWS flats.
b) The project proponent has installed STP of capacity 500 KLD for treatment of wastewater generated from 2 projects i.e. Gillco Towers & Gillco Heights and the same was in operation. The treated wastewater was being discharged into sewer.
c) The project proponent has not provided dual plumbing system for reuse of treated wastewater for flushing purposes.
d) The project proponent is not having adequate area for utilization of treated wastewater for horticulture purposes.
e) The project proponent is disposing off municipal solid waste to the dumping site of Municipal Council, Kharar i.e. no arrangements have been made for composting of organic matter.
The project proponent has failed to comply with the conditions of environmental clearance obtained by him under the provisions of the EIA Notification dated 14/9/2006.
Sh. R. S. Gill stated that STP is installed common for Gillco Heights and Gillco Towers. The ETP is regularly operated and maximum effluent is used for plantation within the colony itself and the remaining is discharged into sewer.
After hearing the officers of the Board and the Chairman of the project proponent, the Chairman of the Board decided as under:
i) The PP will utilize maximum treated wastewater within the project and also explore the possibility to use this treated water in the other project on the other side of Landran Road till the project is fully developed.
ii) The PP will utilize treated effluent by providing dual plumbing system as per EC condition.
iii) The PP will provide urinal in the bathrooms and also provide aquagaurd instead of RO system in the new projects, if the TDS level is less than 750 mg/l.
iv) The consents to operated may be granted.
