File Note: It is intimated that the industry had earlier applied for obtaining site clearance as required in the Factories Act, 1948 on 25/2/2013 at Head Office, Patiala. The comments were sent to Zonal Office-II, Patiala vide this office letter no. 5107 dated 13/3/2013 with the recommendations that the case of industry may be forwarded to SCA-cum-SAC for grant of site clearance for setting up of the unit with suitable conditions. Zonal Office-II, Patiala vide its letter dated 25/3/2013 has recommended to SCA-cum-SAC not to consider the case for grant of site clearance until the study report of pyrolysis plants is received from the committee constituted by the Board. Meanwhile, the State Competent Authority vide its letter no. CSA/2013/S/2849 dated 1/10/2013 returned the application submitted by the industry, mentioning therein that the site of the industry falls in industrial zone as per Master Plan of Mandi Gobindgarh (2010-31), as such, the industry is exempted for obtaining clearance of site under the Factories Act, 1948 from State Competent Authority cum Site Appraisal Committee. The industry was earlier visited by this office on 20/8/2014 and the case was sent to Zonal Office-II, Patiala vide this office letter no. 1563 dated 20/8/2014 to take action against the unit u/s 31-A of the Air Act, 1981. Thereafter, the plant and machinery of the industry were sealed by this office on 2/9/2014 as per the directions received from Competent Authority vide Zonal Office-II, Patiala letter no. 3345 dated 2/9/2014 and the report was sent vide this office letter no. 1766 dated 5/9/2014. In reference to letter no. CSA/2013/S/2849 dated 01.10.2013, the industry again applied for approval of site from SCA-cum-SAC, (which was received on 14.10.2014). The industry was requested vide letter no. CSA/2014/50327 dated 03.12.2014 that if the industry does not want to set up the unit at the proposed site due to any reason (s), a written confirmation in this regard may be submitted. The industry was checked on 27.01.2015 by the committee constituted by the Principle Secretary (Industries) for checking the compliance of sitting guidelines. Thereafter, the case of the industry was considered in the 88th meeting held on 30.01.2015, wherein, it was decided that the industry be asked to re-locates its plant as per the new layout plan and comply with sitting guidelines issued by the Govt. of Punjab, Department of Science, Technology & Environment vide Order no. 10/46/2014-STE(5)/325542 dated 15.10.2014 (6 m wide for movement of fire tender and 0.5 m wide for green belt) all around the plant before its case is considered for grant of site clearance. It was further decided to drop the case from the agenda till the industry re-locates its plant as per the new layout plan and submits compliance report of above mentioned order dated 15.10.2014. Therefore, the industry was advised vide letter no. CSA/2015/S/146 dated 18.02.2015 to comply with the above mentioned observations of the SCA-cum-SAC and send compliance of the same to their office to enable the committee to proceed further in the matter. It was made clear to the industry that till such time their case will not be re-considered by the committee and the case has been dropped from the agenda. It is further intimated that policy was framed by the Department of Science, Technology and Environment, Government of Punjab vide no. 10/46/2014-STE(5)/325542 dated 15/10/2014 for the location of waste tyre based pyrolysis plants and pollution prevention and safety measures required to be adopted by them. As per this policy, the existing plants implies those plants which have already been granted the statutory approvals such as site clearance by SAC/ consent to established/ consent to operate by the PPCB under the Water Act, 1974 and Air Act, 1981 or those which had applied for SAC on or before 31/3/2013. The existing units as defined above and which have applied for site clearance to Site Appraisal Committee under Factories Act, 1948 prior to 31/3/2013 shall be allowed to operate only if they fulfill the following criteria. Their premises have open space all along the boundary @ ½ mt. wide for green belt and 6 mt. wide for movement of fire tenders. Now, the industry has applied for NOC of the Board after obtaining clearnace of SCA-cum-SAC vide its letter no. 2829 dated 22/3/2018 with required documents. The industry has proposed to install one no. reactor of capacity 10 MT/day to provide stack of height 20 mtr alongwith cyclone separator as APCD instead of stack of height 30 mtr and Alkali Scrubber as APCD as required in the policy dated 15/10/2014 for the such type of industries. The industry has proposed to install one no. DG set of capacity 30 KVA equipped with canopy and adequate stack height. The industry has proposed to use wood @ 1.2 T/day as fuel. The industry has not mentioned about utilization of light fuel gas of HSD as fuel, which was earlier mentioned in the application submitted for site clearance from SCA-cum-SAC. The industry has also proposed to install septic tank for treatment of domestic effluent @ 0.9 KLD. The treated domestic effluent will be discharged onto land for plantation and no trade effluent will be generated from the process and cooling water will be recirculate. Top up water @ 2 KLD will be added to the tank meant for cooling water recirculation. The industry has submitted lease deed, which is valid upto 31/10/2032. As the industry has already obained clearance from SCA-cum-SAC, there is no need to visit the industry and if approved, Zonal Office-II, Patiala may be requested to grant NOC for one year for the installation of one no. reactor of capacity 10 Tonne/day to produce Fuel Oil @ 4 T/day, Carbon Black @ 3.5 T/day, Steel Wire @ 1.5 T/day and Light Fuel Gas @ 1 T/day from Waste Tyre @ 10 T/day with suitable conditions and additional following conditions that: 1) The industry shall comply with all the provisions of policy for pyrolysis plants issued by Govt. of Punjab, Deptt. of Science, Technology and Environment vide order no. 10/46/2014-STE (5)/325542 dated 15/10/2014. 2) The industry shall comply with the CGWA Guidelines. 3) The industry shall apply consent to operate under the Water Act, 1974 and Air Act, 1981 alongwith authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 before the re-commissioning of the unit. 4) The indsutry shall obtain various permissions from different departments/ authorities as may be required.
