As per Zonal Office record, the stack emission sampling was carried out by AEE on 15.06.2017 and the analysis results were within the permissible limits. No sampling was carried out by the Regional Office, Fatehgarh Sahib since last 10 months. However, it was mentioned both in the agenda note as well as note dated 17.04.2018 that the stack emission sample could not be collected on 26.03.2018 by the application verifying Officer due to the non-availability of official /Officer of the Air Lab. Further, in the agenda note it was recommended that the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be refused and same was recommended (i.e. for refusal of consent) in the note of AEE dated 17.04.2018, note of AEE dated 24.04.2018, note of AEE dated 26.04.2018 and note of Environmental Engineer of Regional Office, Fatehgarh Sahib dated 26.4.2018. As the Air Pollution Control Device installed by the industry was in bad shape and the stack provided with DG set was also required to be raised therefore, the case was recommended by me for issuance of SCN for refusal of renewal of Air consent with opportunity of personal hearing before Hon'ble Chairman of the Board.
