A perusal of consent agenda note uploaded online, it has been reported by RO that the industry falls in existing industrial zone. As per notified Master Plan of Dera Bassi, the following contents regarding industries falling in existing industrial zone, are given:
"The industries prior to the final notification no. 8355-CTP(PB)/SD-46, dated 13.11.2009 of Master plan Dera Bassi u/s 70(5) of the Punjab Regional and Town planning and Development Act, 1995, which have come under non confirming land use in this master plan may continue to operate and expand within the existing premises only provided that the industry has valid requisite permission of the Punjab Pollution Control Board".
From above contents, it may be observed that the industry is required to have valid permission of the Board in case it want to expand within the existing premises. However, in this case the water & air consents granted to the industry have already been expired on 31/3/2018. RO has forwarded the varied 'consents to operate' of the industry i.e. after expansion, which is not appropriate. Therefore, the industry is required to first get the valid 'consents to operate' for its existing production capacity and thereafter, get NOC for expansion.
If approved, varied 'consents to operate' applied by the industry may be returned and advised to re-submit the same after getting the validity of consents for existing capacity extended as well as NOC for expansion please. |
