It is submitted that earlier the rice shelling unit was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. 461 dated 27.01.2004 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. 459 dated 27.01.2004 in the name of M/s Somnath & company rice mill, village Adhreera, Ropar. The consent were granted for production of 3 TPH of rice and are valid upto 20/01/2019. Thereafter, the industry has submitted request letter wherein it has been mentioned that the rice sheller which was being operated under the name of M/s Somnath & company rice mill, village Adhreera, Ropar has been sold out to M/s Bhangu Rice & General Mills. The present industry has applied for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and submitted a copy of undertaking to the effect that the Rice shelling unit M/s Somnath & Company have been sold out to M/s Bhangu Rice & General Mills. The industry has also submitted and authority letter to the effect that the Rice shelling unit operated earlier under the name of M/s Somnath & Company have been sold out to M/s Bhangu Rice & General Mills, a copy of License issued by Secretary, Market Committee Kurali and copy of Registry of land. Now, the industry has requested for transfer of consent under the provisions of Air (Prevention & Control of Pollution) Act, 1981 and it is added that the consent to operate under the water (Prevention & Control of Pollution) Act,1974 has already been granted to the industry upto 21.01.2019. Further, the industry has also deposited NOC regularization fee of Rs. 2400/- vide R. no. 63/4613 dated 18.04.2018 for the increase in the cost of assets from the last CA certificate submitted by the Industry. The industry has also submitted the compliance reports of the previous consents granted. The industry has also submitted an undertaking to the effect that the rice shelling unit is complying with the code of practise mentioned in the notification dated 15.10.2013. It is further added that the industry has submitted analysis report of the stack emissions from the Board approved laboratory namely M/s Chandigarh Pollution Testing laboratory dated 24.02.2018 and the analysis results of the Particulate matter (mg/Nm3) is 74.6 which is within the prescribed limit of 150 (mg/Nm3) as per guidelines of the Board. And, as per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange & Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, as such, the rice shelling unit covers under orange category, therefore, in view of facts mentioned above, it is recommended that the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be transferred/granted up to 20.01.2019 in the name of M/s Bhangu Rice & General Mill subject to the suitable conditions.
