It is intimated that the educational institute has established without consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 of the Board.
The industry was given personal hearing before the Chief Environmental Engineer on 25.08.2014 and it was decided as under:-
1) The institute shall submit feasibility report of sewage treatment plant being installed within 07 days.
2) The institute shall install/ commission the sewage treatment plant, develop adequate land alongwith pipeline network to utilize entire effluent control land for plantation within 01 month.
3) The institute shall apply for consents of the Board under the Water Act, 1974 as amended in 1988 and Air Act, 1981, as amended in 1987 alongwith complete documents within 01 month.
4) The Regional Office, Hoshiarpur shall verify the facts at site, collect effluent samples and submit detail report alongwith recommendations for further action, immediately after 01 month.
As such, the bank guarantee of Rs. 2.00 lacs was submitted the project proponent and STP was got installed by the institute. However, the institute failed to apply for consent to operate of the Board under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. The matter was considered by the Competent Authority and it was decided to encash the bank guarantee of Rs. 2.00 lacs and same was encashed by the Board vide receipt no. 77/4213 dated 31.05.2016. After that, the institute was regularly perused to apply for consents.
Now, the educational institute has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents i.e. detailed CA Certificate, list of trust members, occupancy certificate, jamabandi, detail of khasra no., copy of registry, date of commissioning proof and has Rs. 450000/- vide receipt no. 63/4698 dated 10.05.2018 under Air Act, Rs. 450000/- vide receipt no. 64/4698 dated 10.05.2018 under Water Act, Rs. 35000/- vide receipt no. 65/4698 dated 10.05.2018 as NOC regularization fee and Rs. 500/- vide receipt no. 66/4698 dated 10.05.2018 as an application form fee. The fee deposited is adequate upto 30.09.2022.
The industry was visited by AEE of this office on 23.05.2018 and it was observed that the institute was in operation. The institute has constructed 8 blocks having total built up area of 19958 sq.mtr. The institute was established in the year 2004. The institute has strength of 1200 students and 100 faculty members along with other staff. The domestic effluent generated from the premises is discharged in to STP. The STP consists of collection tank, MBBR Tank cum aeration tank, settling tank, sand filter & activated carbon filter. The treated effluent is discharged onto land for gardening within the premises. The domestic effluent is generated @ 9 KLD (only day scholars are there). The effluent sampling of the treated effluent was carried out on 23.05.2018 and results are awaited. The institute has installed 02 DG Sets of capacity 63 KVA with canopy and adequate stack height.
In view of above, it is recommended that
1) consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the institute for the period upto 30.09.2022.
