It is intimated that the industry is a small scale orange category plastic unit and was granted consents under the Water Act, 1974 vide no. CTOW/Renewal/LDH2/2017/5398814 dated 4/5/2017, valid upto 10/10/2017 and under the Air Act, 1981 vide no. CTOA/Renewal/LDH2/ 20175398782 dated 4/5/2017, valid upto 30/9/2020, for the manufacturing of Plastic Granules @ 1.5 MTD. Earlier, the consent to operate granted under the Water Act, 1974 was revoked by Zonal Office-1, Ludhiana vide its letter no. 6702-03 dated 10/10/2017. Thereafter, the area of tehsil Khanna was transferred to RO, Fatehgarh Sahib and the industry was issued for revocation/ cancellation of consent to operate granted under the Water Act, 1974 vide Board's letter no. 1171-72 dated 13/4/2018 and the Air Act, 1981 vide Board's letter no. 1154-55 dated 13/4/2018 as the industry as found violating the provisions of the Water Act, 1974 and the Air Act, 1981.
Now, the industry has applied for obtaining varied 'consent to operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents (without washing process). As per the record file of the industry, the consent fee deposited by the industry are adequate under both Acts is adequate upto 30/9/2022 as per Board's Office Order dated 18/7/2013.
Accordingly, the industry was visited by the AEE of this office on 17/5/2018. Sh. Ashok Kumar, Representative of the industry was present at the time of visit. During the visit, it was observed as under:
1. The industry was not in operation.
2. The industry has stopped the washing process in this unit. All the washing activities are being carried in M/s Vijay Plastic (Unit-III) only.
3. The industry has installed one no. extruder, which has been provided with wet scrubber as APCD.
4. The industry has not installed any DG set in the industrial premises.
5. No water is used in the process, so no trade effluent is generated.
6. The industry has not provided any toilet, only sullage water is generated, which is being discharged onto land for plantation.
Further, w.r.t Zonal Office-II, Patiala letter no. 1569 dated 9/5/2018, it is submitted that the reply of show cause notice submitted by the industry was verified and found the correct and details are mentioned above.
Furthermore, as per the guidelines issued by Central Ground Water Authority (CGWA), the site of the unit falls under Khanna block which has already been declared as notified area by Central Ground Water Authority (CGWA). Moreover, the Board has also clarified vide SEE (HQ-1) Head Office letter no. 7956-97 dated 9/3/2018, the operative part of this letter is as under:
“It has been decided that the Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the authorities concerned as notified by the Central Ground Water Authority. However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.”
The industry is complying with the conditions of consent to operate under the Water Act, 1974 and Air Act, 1981 as well as conditions of NOC for expansion granted to it. Further, the industry is located in the non-industrial area as per Master Plan of Khanna as per DTP letter no. 3423 dated 29/11/2013 in which it has been mentioned that the proprietor can operate its unit at the said site for 10-years from the date of notification of notified Master Plan of Khanna.
In view of above, it is therefore recommended as under:
i) Notice u/s 33-A of the Water Act, 1974 issued by the Zonal Office-I, Ludhiana may please be dropped.
ii) Show cause notices under both the Acts issued by Zonal Office-II, Patiala may also please be dropped.
iii) The industry may be granted varied consent to operate under the Water Act, 1974 upto 30/9/2022 with suitable conditions and additional condition that the industry shall comply with CGWA guidelines.
iv) The industry may be granted varied consent to operate under the Air Act, 1981 for a short period with suitable conditions and additional condition that the industry will submit analysis report of stack emission carried out by the Board's Lab/ Board's approved Lab within one month.
