It is intimated that the stone crusher was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, which are valid upto 30.06.2018.
Further, it is intimated that the industry was visited by the officer of the Board on 01.09.2016, 02.05.2017 and observed that the industry was not complying with the code of the practice prescribed by the Board for the stone crushers. The industry was issued show cause notice for revocation of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 along with personal hearing before the Environmental Engineer on 15.11.2017 vide this office letter No. 5459 dated 08.11.2017. The industry was issued proceedings of the personal hearing vide this office letter No. 5693 dated 28.11.2017, where it was decided as under:-
1) The stone crusher owner shall deposit bank guarantee amounting Rs. 1.00 lac within 15 days for the compliance of code of practice.
2) The industry shall comply with code of practice within 15 days.
3) AEE shall visit the stone crusher to check the compliance of decision No. 2 after one month.
The consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 was revoked vide this office letter no. 1628 & 1631 dated 16.04.2018 as per decisions of the Competent Authority.
Now, the stone crusher has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The stone crusher has deposited Rs. 12000/- vide recipt no. 97/4698 dated 22.05.2018 under Air Act, Rs. 12000/- vide recipt no. 98/4698 dated 22.05.2018 under Water Act and Rs. 500/- vide recipt no. 96/4698 dated 22.05.2018 as an application form fee, which is adequate for the period upto 30.06.2023. The industry has submitted application form, CA Certificate, copy of earlier granted consents, mining registration from GM cum Mining Officer, Shaheed Bhagat Singh Nagar.
The stone crusher was visited by AEE of this office on 23.05.2018 and observed that :-
1) The stone crusher was not in operation.
2) The stone crusher has installed one jaw crusher, one rotopactor, two vibrating machines, one DG set of capacity 320 KVA with canopy.
3) The stone crusher has provided conventions chutes on the conveyors.
4) The stone crusher has provided sprinklers on the ramp side and on the boundary. The stone crusher has also provided moveable water tanker for the sprinkling of water vehicle movement area.
5) The stone crusher has provided plantation along the boundary wall.
6) The stone crusher has provided water meter on the tubewell.
7) The stone crusher has stabilized the movement area with the gravel material.
8) The stone crusher has covered the crushing machinery.
9) The stone crusher has provided re-circulation tank for the collection of effluent.
10) The industry has submitted bank guarantee of Rs. 1.00 lac as per decisions of personal hearing.
In view of above, it is recommended that showcause notice for refusal of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be issued to the industry as the industry has failed to submit the bank guarantee of Rs. 1.0 lac till date.
