File Note: Sir, the industry was visited on 4.6.2018 and was still found not in operation. The brief case history is as under:- 1. The air emission sample of the industry was collected earlier as per the special condition of the earlier granted consent and the sample failed to qualify with the prescribed limits of the board. 2. Thereafter, The case was sent to the competent authority and it was recommended to grant short term consent to operate to the industry with the special condition that the industry shall get its air emission samples re-analyzed from board's lab as the industry is a forging unit and uses F.O. as fuel in the forging furnaces. 3. The case was considered by the competent authority and show cause notice for refusal of Consent to operate under Air Act, 1981 was issued to the industry with an opportunity of personal hearing in which, it was decided that the industry shall submit a bank guarantee of Rs. 50000/- and regional office will collect the air emission sample and submit conclusive report in the matter. 4. Thereafter, the industry was visited on 29.5.2018 and was found not in operation. The representative of the industry told that their bank accounts have become NPA and they are not in position of submitting the bank guarantee. They are operating the industry on and off. The statement of the industry seems to be justified as the industry was not even able to submit the consent fees for 2 years. The cheques of consent fees submitted by the industry were returned twice by the bank due to non availability of balance . However, due to to continuous perusal by this office on the account of audit objections , the industry has submitted the consent fees in cash that too at the closing date i.e.31.3.2018 and receipts were issued to the industry . In view of above, it is recommended that as the case is pending since long, either the industry may be granted consent to operate for short period with the special condition that the industry shall submit the BG of Rs.50000/- within 15 days or the case oif the industry may be returned with a direction to re-apply the case after the submission of the Bank Guarantee and getting the samples analyzed from Board's Lab
