It is submitted that the rice sheller was granted consent to operate under Air Act, 1981 vide no. O14SASCTOA1908276 dated 30/08/2013, which is valid upto 30.06.2018 for processing of paddy @ 2 TPH (with mechanical drier).
Now the industry has applied for renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and fresh consent to operate under the Water Act, 1974. The rice sheller had deposited Rs. 30,500/- vide R. No. 14/4615 dated 12/06/2018 (Rs. 15,000 each on account of water and air consent fee and Rs. 500/- as application form fee) against the fixed assets of Rs. 67.9 lacs as on 28/05/2018 as per CA certificate. The industry has applied for the first time under the Water Act, 1974, as such, a clarification was raised through online system, with a request to the industry to deposit consent fee under the said Act, from the time the unit was commissioned. In reply to the said clarification, the industry has submitted that it has started generating domestic effluent from year 2013, as such, the consent fee may be charged from year 2013. The industry has deposited Rs. 15,000/- as additional consent fee under the Water Act, 1974 vide R. No. 74/4615 dated 02.07.2018. As such, the fee deposited by the industry is adequate upto 30.06.2023 under both the Acts.
It is added here that rice shellers are covered under ‘Orange category’ and, as per the office order dated 02.20.2016, issued by the Board, the green and orange category of industries shall be granted renewal of consents under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without visiting the site of the industry.
It is added here that along with the online application from, the industry has submitted an undertaking in the agenda note attached herewith.
In view of above, the industry may be granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 30.09.2022 subject to suitable conditions.
