Subject: Show Cause Notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act 1974 & Air (Prevention & Control of Pollution) Act 1981 -
Whereas it is obligatory on the part of industry to obtain the 'consent to operate' of the Board u/s 25/26 of Water (Prevention & Control of Pollution) Act 1974 & Air (Prevention & Control of Pollution) Act 1981 for discharge of effluent/emissions from its industrial premises and to operate an outlet.
And whereas, it is mandatory on the part of industry to install proper and adequate effluent treatment plant/Air Pollution Control Device so that the concentration of various pollutants conforms to the effluent/emissions standards prescribed by the Board.
And whereas, the industry had applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981 and same were refused vide no. CTOA/Varied/JAL/2017/5609212 dated 26.09.2017 reasons mentioned therein.
And whereas the industry was visited by the AEE on 22.06.2018 and it was observed as under.:-
1. Sh. Manoj Kumar Manager of the industry was contacted at site. The industry was in operation during the visit and was engaged in the process of manufacturing of tyres.
2. The industry has installed 14 presses out of which it has installed 07 new presses, 12 nos. tyre building machines out of which 3 nos. machines have been recently added. The industry has installed one extruder, one calendar machine, 3 nos. mixing mill.
3. The industry has installed one boiler of cap 03 TPH with twin cyclones followed by the alkali scrubber as APCD and same was not in operation. The representative of the industry informed that the industry was not using its boiler of capacity 3 TPH. The industry has now installed one another boiler of capacity 5 TPH with multi cyclones followed by wet scrubber as APCD. But during visit, wet scrubber was not in operation.
4. The industry has made arrangement for the disposal of its domestic effluent and boiler blow down still into underground pipeline, which leads to the Kala Sanghian drain along with the effluent of the dairies and nearby area.
5. The industry has already submitted a bank guarantee of Rs. 2 lacs which was expired on 13.12.2017. But the industry has failed to submit extended bank guarantee till date.
And whereas, industry is violating the various provisions under the Water Act (Prevention & Control of Pollution) Act, 1974 and Air Act (Prevention & Control of Pollution) Act, 1981.
And whereas the matter has been considered by the Competent Authority and it has been decided to refuse the consent to operate under the Water Act (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981 applied by the industry and reply within 07-days due to above said reasons.
And as such, in exercise of the powers conferred upon u/s 25/26 of the Water Act (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act 1981 as amended in 1987, is hereby, refuse and reply within 07-days due to the reasons mentioned above.
