It is submitted that the industry is a small rolling mill unit and was granted consent to operate under the Water Act, 1974 and under the Air Act, 198 both valid upto 30/6/2018 for the manufacturing of Bar round angle @ 15 TPD.
Earlier, a Bank Guarantee amounting to Rs. 100,000/- was imposed on the industry as an assurance to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. In compliance, the industry deposited BG of Rs. 100,000/- vide no. 10/2013-13 dated 24/01/2017. Out of which, 25% i.e Rs. 25,000 were encashed in compliance to decision of personal hearing dated 28/03/2018 and now the industry has submitted BG amounting to Rs. 75,000/- vide no. 1/1268/2018-19 dated 18/07/2018 having validity upto 17/07/2019.
Now, the industry has applied for obtaining renewal of 'consent to operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents. The consent fee is now adequate upto 30/6/2023 as per Board's Office Order dated 18/7/2013.
It is further submitted that as observations regarding status of recuperator, VFD, paved entry /exit and stabilization of movement area are being raised by the Zonal Office-II, Patiala, accordingly, the industry was visited by the AEE of this office on 23/07/2018 and it was observed as under:
1. The industry was in operation during visit.
2. The industry has installed one reverberatory type furnace. The industry uses pulverized coal as fuel in its furnace and has installed pulverizer, which is equipped with inbuilt bag filter house as APCD.
3. The industry has installed cyclone separator followed by wet scrubber as APCD along-with stack of adequate height, which was in operation during visit.
4. The industry has already installed recuperator and VFD.
5. The industry has also submitted stack emission sample was collected by Board's Approved Lab namely M/s Sophisticated Industrial Material Analytic Labs Pvt. Ltd. On 18/06/2018. As per the analysis results, the concentration of SPM was found to be 132 mg/Nm3, which is within the permissible limits of 150 mg/Nm3 as laid down by the Board.
6. The industry has installed D.G. set of capacity 15 KVA, which is equipped with canopy & stack of adequate height.
7. No water is being used in the process; therefore, there is no generation of trade effluent. Whole of the water being used in the wet scrubber and for cooling, is re-circulated.
8. The domestic effluent being generated by the industry is discharged onto land for plantation after passing through septic tank.
9. The industry has stabilized the movement area provided paved entry/exit of industry.
Further, the industry is located in the Industrial Zone as per Master Plan of Khanna.
Furthermore, as per the guidelines issued by Central Ground Water Authority (CGWA), Khanna Block of Ludhiana District falls in the list of notified area. As this industry does not fall in the list of water intensive industries and only require water for cooling and drinking purposes. Moreover, the Board has also clarified vide SEE (HQ-1) Head Office letter no. 7956-97 dated 9/3/2018, the operative part of this letter is as under:
It has been decided that the Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the authorities concerned as notified by the Central Ground Water Authority. However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.
In view of above, it is therefore recommended that:
1. The industry may be granted consent to operate under the Water Act, 1974 upto 30/9/2022 with suitable conditions and special condition.
a. The industry will comply with the CGWA guidelines.
2. The industry may be granted consent to operate under the Air Act, 1981 upto 30/9/2022 with suitable conditions
