It is submitted that Regional Office has forwarded the case for consents to operate under the Water Act, 1974 & Air Act, 1981 as per the details mentioned in the agenda note. The agenda note has been examined & observed as under:-
1. Consent to operate under the Water Act,1974 & Air Act,1981 were granted to the industry vide no’s. R15FZRCTOW2780779 & R15FZRCTOA2780755 dated 05.06.2015 for production of premix @ 45 TPH, valid for a period upto 30.06.2017 subject to the suitable conditions mentioned therein.
2. The Executive Engineer, PWD (B&R), Division Ferozepur vide its letter no. 319 dated 22.05.2018 sent list of 04 Hot Mix Plant including M/s J.K. Associates and requested this office to verify the consents to operate granted to the Hot Mix Plant by The Board as it has submitted copy of consents to their department which are valid upto 30.06.2019.
3. Accordingly, record file of the industry was checked and found that the Contractor has submitted tempered copy of consents to operate with validity upto 30.06.2019 to the department of PWD (B& R) to get the tender allotted. Hence, report regarding tempered consents has been sent to the Executive Engineer, PWD (B&R), Division Ferozepur vide this office letter no. 1891 dated 24.05.2018.
4. The industry vides its application dated 11.06.2018 applied for renewal of consents to operate under the Water Act,1974 & Air Act,1981 and has submitted all the requisite documents, compliance report of previous consents conditions and NOC issued by District Town planner, Ferozepur vide letter no. 616-617 dated 17.04.2018 valid for a period upto 31.01.2020 etc.
5. The industry was visited by officer of Regional Office on 22.06.2018 and during visit, some incompletionswere observed there. Keeping in view the observations noticed during visit, applications of the industry for obtaining consents to operate under the Water Act,1974 & Air Act,1981 were returned to it.
6. The industry again vide its application dated 18.07.2018 has applied for renewal of consents to operate under the Water Act,1974 & Air Act,1981.
7. The industry was visited by officer of Regional Office on 23.07.2018 and it was observed that:
a) The industry was not in operation. However, raw material was found stored at the site. Physical condition of the plant showed that it has not been operated since long.
b) The industry has installed Dust collector followed by wet scrubber with water re-circulation system as air pollution control device to contain the emissions from rotary drum, which was in line/operation-able condition.
c) The industry has provided separate energy meter with the APCD.
d) The industry has provided stack of adequate height above ground level with the APCD alongwith adequate sampling facility to facilitate the emission sampling.
e) The industry has provided stacks of adequate height with 02 bitumen heaters.
f) The industry has stabilized the vehicular movement area within its premises with stone aggregates and has made arrangement for sprinkling of water to supress the dust emissions generated during vehicular movement through pipeline.
g) The industry has installed 01 canopy-based DG set of capacity 125 KVA in its premises with stack of adequate height above roof level.
h) The industry has made adequate plantation along its boundary wall.
i) The industry has complied with the provisions of the Water Act,1974 & Air Act,1981.
Regional Office has recommended that consents to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the industry for a period upto 30.09.2019, subject to the specific condition that the industry will submit its operational schedule during allocation of work to it by the Executive Departments so as to collect and analyse emission sample in Boards lab, within a period of 3 months.
If approved, consents to operate under Water Act,1974 and Air Act,1981 may be issued to the industry for a period upto 30.09.2019 with suitable conditions alongwith special condition that the industry will submit the operational schedule for the operation of hot mix plant to the Regional office, Faridkot.
