At the outset of the hearing, Environmental Engineer informed that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was granted to the industry which is valid upto 31.07.2018.
The industry has now applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS.
The application of the industry has been examined and it was observed that the industry is established in year 2012 after the notification of Master Plan in 2007-08 in mixed industrial zone. Therefore, it cannot be allowed in mixed industrial zone after the notification of Master Plan, Ludhiana.
The industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana. The hearing was scheduled for 06-08-2018.
Sh. Gulshan Bansal, Proprietor attended the hearing on behalf of the industry and submitted that the industry was commissioned in 1993-94 before the notification of Master Pan of Ludhiana and submitted the copy of Central Sale Tax number mentioning the date of commissioning as 02-11-1993. He further that they had deposited the requisite consent fees from year 1993-94 and requested to grant the consents.
After hearing the officers of the Board and the representative of the industry, the Senior Environmental Engineer, Zonal Office-2, Ludhiana decided that Environmental Engineer, Regional Office-3, Ludhiana shall verify the contention of the industry regarding deposition of adequate consent fee and submit the report along with recommendations to decide the consent application accordingly, within 3 days.
The proceedings of the hearing are added herewith for the confirmation and approval by the Competent Authority, so as to convey the same to all the concerned for necessary compliance please.
