Sub: Proceeding of the personal hearing regarding show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 before the Senior Environmental Engineer of the Board on 14.08.2018 to M/s Kundan Products (India), Surjit Cinema Road, Near S.S. Lotey Kanda, Industrial Area –C, Ludhiana.

The Asstt. Environmental Engineer, Regional Office-2, Ludhiana brought out that the industry was granted consent vide no. CTOW/Fresh/LDH2/2018/6748904 dated 17.01.2018 valid upto 16.07.2018 under Water Act, 1974 & vide no. CTOA/Fresh/LDH2/2018/6748818 dated 17.01.2018 valid upto 16.07.2018 under Air Act, 1981 and electric connection of the industry was also restored for six months.
And whereas, the industry has applied for the renewal of consent to operate under Water Act, 1974 & Air Act, 1981 through online system alongwith requisite documents. The site of the industry was visited by the AEE of this office on 24.07.2018 in reference to the list received from M/s JBR Technology Pvt. Ltd., Ludhiana regarding less lifting of trade effluent against the MOU made with CETP operator and it was observed as under:-
1. The industry was in operation and engaged in drawing of M.S. Round involving pickling process.
2. The industry has made an MOU with CETP operate of quantity 2000 Ltr/month. Industry has provided water meter on its fresh water supply line and maintaining the record of fresh water consumed in process area and trade effluent lifted to CETP operator. The industry is lifting its trade effluent @ 1000 ltr/month against the agreement 2000 Ltr/month.
3. The industry has made bye-pass arrangements near the pickling tank to discharge its trade effluent into sewer. During visit, flexible pipe was also observed near the pickling tank.
4. Domestic effluent is being discharged into sewer.
5. Earlier the D.G set was sealed on 30.11.2017, but during the visit it was observed that industry has broken the seal earlier provided on its D.G set which is without canopy
In view of above, the industry was issued show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through online alongwith an opportunity of personal hearing before Senior Environmental Engineer of the Board on 14.08.2018.
During the hearing the representative of the industry could not make any reply to the violations observed as above.
After hearing the representative of the industry, officer of the Board and considering background of the case and material facts on the record, the Senior Environmental Engineer of the Board decided as follow:-
1. The consent applied by the industry under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be refused.
2. The E.E R.O-2, Ludhiana shall ensure the compliance of the already directions issued u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974.
