The note history of application may please be perused. As per observations made by EE (ZP-I) on 25/08/2018, which are as under;
The project proponent M/s Aastha Enterprises has developed 2 projects i.e. Aastha Apartments & Aastha Apartments-I in the revenue estate of Vill. Bhabat, Zirakpur, Distt. SAS Nagar in an area of 1.79 acre & 1.29 acre having 96 flats & 72 flats, respectively. The consent granted to the project proponent (Aastha Apartments-I) under the Water Act, 1974 was revoked vide letter no. 3948 dated 8/7/2016 due to non-operation of sewage treatment plant. Subsequently, the directions u/s 33-A of the Water Act, 1974 were issued to the Deptt. of Local Government vide Board's letter no. 8544 dated 19/12/2016 to the effect that; "That the authorities concerned shall cancel the license(s) issued to the project proponent M/s Aastha Enterprises for its projects i.e. "Aastha Apartments and Aastha Apartments-I" at Vill. Bhabat, Zirakpur, Distt. SAS Nagar till the project proponent complies with the statutory requirements of the Environmental Laws". A copy of above directions was also endorsed to Tehsildar, Sub Tehsil, Zirakpur with the request not to register any sale deed of flats etc. in the above projects. The project proponent was afforded an opportunity of personal hearing before the Worthy Chairman of the Board on 15/1/2018 and the proceedings of the hearing were uploaded. Now, the project proponent has applied for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981. A perusal of consent agenda note uploaded online, it has been observed that the above details are not mentioned in the agenda note.
EE RO, SAS Nagar is, therefore, requested to submit reply of above observations and also submit complete report w.r.t. in completions observed by the Board from time to time as mentioned in the proceedings of the hearing dated 15/1/2018. |
