It is submitted that the rice sheller was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. RO/SGR/WPC/RS/F-207/R-583 dated 22/08/2007 and the Air Act, 1981 vide no. RO/SGR/APC/F-1844 dated 03/01/2013, which were expired on dated 30/06/2018, for production of raw rice @ 2.5 TPH by processing of paddy @ 3.75 TPH as raw material under red category subject to certain conditions mentioned therein.
Now, the rice sheller has applied online for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 under Orange category for the production of raw rice @ 2.5 TPH by processing of paddy @ 3.75 TPH. The rice sheller has submitted compliance report of the conditions of the consent earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, latest CA certificate and an undertaking to the effect that the rice sheller is complying with the conditions of the consents earlier granted to it.
Sh. Yatinder Kumar, Partner of the rice sheller submitted an undertaking, wherein, it has been mentioned as under:
1. I Sh. Yatinder Kumar, Partner of M/s Gobind Rice Mills, Balial Road, Bhawanigarh, Distt. Sangrur.
2. I shall not operate the rice shelling unit without the valid consent to operate of the Board under Air (Prevention &Control of Pollution) Act, 1981 and/ or consent to operate under the Water (Prevention & Control of Pollution) Act, 1974.
3. I shall ensure the compliance of code of practice laid down by Govt. order no. 10/48/2004-STE (4) /932 dated. 15/10/2013 at all the times in true letter & spirit.
4. I shall get the stack emission sample of my rice shelling unit analyzed from Board / Board's approved private lab in the coming season and thereafter shall submit the analysis report to the Board within 10 days.
5. I shall provide rotary valve (if not provided already) below the cyclone for removal of particulate matter contained by the APCD and sampling arrangements with the stack attached to the APCD within 15 days and submit compliance in this regard to the Board immediately thereafter.
6. I shall keep the APCD in good running conditions at all the times and shall also operate the same properly and effectively so as to achieve the standards prescribed by the Board.
7. I shall dispose of the dust contained by APCD in an environmentally sound manner.
8. I shall ensure to put in place all the hoods, ductings& enclosures and other components of the APCD well before commissioning of the unit for next paddy shelling season and report the compliance in the regard to the Board prior to commissioning of the unit.
9. There is no change in the plant and machinery of the unit after the grant of previous consent by the Board and the production capacity of the unit is the same for which the unit was granted earlier consent by the Board.
10. There is no change in the treatment system and mode of disposal of treated waste water. The industry only generates domestic effluent and the same is discharged onto land for plantation after passing through septic tank.
11. I have provided proper and permanent approach to the sample collection facility and the same shall be maintained in proper conditions at all the times.
12. I shall make plantation in the open area, where the same is feasible, to contribute to increase in the green cover and shall inform the Board in this regard before commissioning of the unit before next shelling season.
13. I acknowledge that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has also submitted the compliance report of conditions of the consents earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited consent fee, Rs. 21,600/- Vide R.No. 62/4791 dated 02.08.2018 under Water Act, 1974& Rs. 21,600/- Vide R.No. 61/4791 dated 02.08.2018 under Air Act,1981.
The fee deposited by the rice sheller is adequate upto 30/09/2032 as per CA certificate showing the value of fixed assets of Rs. 18.1 Lacs as on dated 27.07.2018.
It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.
Keeping above in view above mentioned facts, it is, therefore, recommended that renewal of consent to operate under the Water Act, 1974 may be granted to the industry upto 30/09/2025 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30/09/2019 for the production of raw rice @ 2.0 TPH by processing of paddy @ 3.0 TPH subject to the suitable conditions as per the policy of the Board and following additional conditions: -
1. The rice sheller shall ensure the compliance of code of practice laid down by Govt. order no. 10/48/2004-STE (4) /932 dated. 15/10/2013 at all the times in true letter & spirit.
2. The rice sheller shall get its stack emission sample analyzed from Board / Board's approved private lab in the coming season after commissioning of the unit and thereafter shall submit the analysis report to the Board.
3. The rice sheller shall put in place all the hoods, ducting’s & enclosures and other components of the APCD well before commissioning of the unit for next paddy shelling season and report the compliance in the regard to the Board prior to commissioning of the unit.
4. This consent has been granted to the rice sheller based on the undertaking submitted by the industry, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of the said undertaking is found false and action shall be taken to revoke/ cancel this consent without issuance of any further notice/opportunity.
5. The industry shall provide rotary valve (if earlier not provided) below the cyclone for removal of particulate matter contained by the APCD and sampling arrangements along with the stack attached to the APCD within 15 days and submit compliance in this regard to the Board immediately thereafter.
6. The industry shall not generate and discharge any kind of trade effluent from its process, only domestic effluent will be discharged onto land for plantation after passing through septic tank.
7. The industry shall comply with the guidelines issued by Central Ground Water Authority (CGWA) from time to time.
8. The industry shall be bound to achieve the emissions standards laid down by the Board and amended from time to time.
