Sub: Proceeding of the personal hearing regarding show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 before the Senior Environmental Engineer of the Board on 21.09.2018- M/s Pristine Mega Logistics Park Pvt. Ltd, Village Chawa, H.B No. 158, Below Rail Over Bridge Chawa Payal, Near Rly. Station, Samrala, Distt. Ludhiana.

The Environmental Engineer, Regional Office-2, Ludhiana brought out that the industry was earlier given personal hearing before the Senior Environmental Engineer, Zonal office-1, Ludhiana on 4.7.2018, wherein it was decided that Environmental Engineer, Regional Office to verify the statement given by the representative of the industry & also to verify the reply submitted by it and submits the report. And whereas, the industry was visited by officer of the Board on 11.7.2018 and it was observed that:-
1. The project proponent has provided small pumps are used to transport it into main tanks.
2. During visit, it was observed that the repair work of lining of additional small tank excavated into ground for storing residual palm oil collected from main pipeline after its cleaning has almost been finished and only cleaning of the tank was due.
3. The project proponent has cleared the plantation around the storage area and no spillage was found.
4. A new stack was found lying inside the premises and the project proponent informed that the 0.75 TPH boiler will be provided adequate stack height.
5. The project proponent informed that only the in house repair work of trucks owned by the project proponent is done inside the premises and the disposal of waste oil and filters is done as per hazardous waste rules, however, he could not produce supporting documents at the time of visit.
In view of above, the industry was issued show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through online alongwith an opportunity of personal hearing before Senior Environmental Engineer of the Board on 21.09.2018.
No one attending the hearing on 21.09.2018. Thereafter, the representative of the industry attended the office on 24.09.2018 and submitted that now industry has provided adequate stack on its second boiler.
After hearing the representative of the industry and considering background of the case and material facts on the record, the Senior Environmental Engineer of the Board decided as follow:-
1. Environmental Engineer, Regional office shall verify the contention of the industry within 7 days.
2. Environmental Engineer, Regional office shall process the consent applications of the industry on merit.
