As discussed agenda note prepared and attached herewith for further necessary action, pls.
Remarks :
• The industry was granted ‘Consents to Establish’ under Water Act, 1974 & Air Act, 1981 vide no. CTE/Fresh/BTI/2017/6507165 dated 06.10.2017 for operation of rice sheller unit of capacity 02 TPH of raw rice/sorted rice, subject to the conditions mentioned therein.
• The industry was issued show cause notice for violations of the provisions of Water Act, 1974 & Air Act, 1981 vide no. 4731 dated 02.11.2017 to explain his position in person, writing a period of 15 days, but the industry has not submitted any reply. Thereafter, the industry was issued show cause notice with an opportunity of personal hearing on 07.02.2018 vide no. 383 dated 23.01.2018. However, the industry has failed to attend the said hearing & the report has sent to Zonal Office, Bathinda vide this office letter no. 2518 dated 15.03.2018.
• The Senior Environmental Engineer, Zonal Office, Bathinda has issued show cause notice for violations of the provisions of Water Act, 1974 & Air Act, 1981 vide no. 1725 dated 14.05.2018 to explain his position in person, writing a period of 15 days.
• Now, the industry applied for consent to operate under the Water Act, 1974 & Air Act, 1981 for operation of rice sheller unit of capacity raw rice/sorted raw rice @ 2 TPH without dryer. The details of the case is as under:-
The industry was visited by AEE of this office on 05.10.2018 and it was observed that :-
1. The rice sheller unit was not in operation due to off-season.
2. The industry has installed cyclone as APCD with shelling section to contain the process emissions and the same was in line / operation with all dust emitting points connected to the APCD.
3. The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling.
4. The industry has provided brick paving at movement area of vehicles, within its premises to prevent the generation of dust emissions.
5. The industry has provided brick wall of adequate length with 10' height around husk discharge / storage area and further wind screen of MS of 5’ height has now been provided above the said wall in compliance to the code of practice prescribed by the Govt. vide order dt. 15.10.2013.
6. The industry has provided septic tank for treatment of domestic effluent from office section & same was disposed off onto land for plantation along its boundary wall.
7. The industry has made plantation / saplings along its boundary wall.
The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
Recommendations : Keeping in view of above, if approved, it is recommended that ‘consent to operate’ under the Water Act, 1974 & Air Act, 1981 may be granted to the industry for operation of rice sheller unit of capacity 2 TPH of raw rice / sorted rice without dryer for a period upto 30.09.2019, subject to the suitable conditions along with following specific condition that the industry shall submit the analysis report of emission sample from stack after one month of re-commissioning of unit for paddy season 2018-19.
