It is intimated that the educational institute has established without consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 of the Board. The school was given personal hearing before the Senior Environmental Engineer on 16-08-2016, wherein it was decided as under:-
1) The Regional Office, Hoshiarpur shall seal the DG Set of the school of unknown capacity which is without canopy.
2) The school shall apply for consent to operate of the Board under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 within 07 days.
3) The school shall submit the bank guarantee of Rs. 1.0 lac with the validity of 1 year within 7 days as an assurance to comply with the provisions of the Water Act, 1974 and Air Act, 1981.
4) The school shall make proper arrangement for proper disposal of the municipal solid waste.
5) The school shall install the sewage treatment plant within 30 days.
6) The regional office, hoshiarpur shall process the consent applications on the merit.
The report in this regard was sent to Zonal Office, Jalandhar vide letter no. 1105 dated 09-03-2017.
The school was again given personal hearing before the Senior Environmental Engineer on 09-11-2017, wherein, it was decided as under:-
1) The institute shall apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 07 days.
2) The Regional office, Hoshiarpur shall verify the contentions made by the representative and submit report to this office within 07 days.
The report in this regard was sent to Zonal office letter no. 1466 dated 10.04.2018. Further, it is intimated that the bank guarantee of Rs. 1.0 lac was submitted by the school in compliance to the hearing decision.
Now, the educational institute has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. The industry has deposited Rs. 132600/- vide receipt No. 3/4919 dated 14.02.2019 under Air Act, Rs. 132600/- vide receipt No. 4/4919 dated 14.02.2019 under Water Act, Rs. 10800/- vide receipt No. 2/4919 dated 2/4919 dated 14.02.2019 as NOC Regularization fee and Rs. 500/- vide receipt No. 1/4919 dated 14.02.19 application form fee.The fee submitted is adequate upto 30-09-2023.
The industry has submitted CA Certificate, copy of Jamabandi, Building Plan, Location Plan, List of Members, Completion certificate of STP, Drawing of STP, Authority letter, date of commissioning proof.
The school was visited by AEE of this office on 14.02.2019 and it was observed that the school was in operation. The school has constructed two main blocks having classes from nursery to 12th standard. The area of the school is about 8365 sq/mtr. The strength of school is about 1000 including staff members and other workers. The school has provided STP for the treatment of domestic effluent. The STP consist of Oil & Grease Trap, Primary Clarifier, Bio Reactor MBBR, Secondary Clarifier, Activated Carbon, Filter. The treated effluent from the STP is discharged onto plantation around the periphery and onto the lawns. The school has installed one DG set of capacity 125 KVA with canopy and adequate stack height. Further, it is intimated that the educational institute was established in year 2009 as per the application form submitted by the school and as such was established before the notification of the Master plan of Hoshiarpur. The site of the school is situated outside the master plan of Hoshiarpur as per notification dated 02.05.2011. The effluent sample from the outlet of the STP was collected on the 13.02.2019 and the results are awaited.
In view of above, it is recommended that
1.Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be decided keeping and view the analysis results of the samples.
