It is submitted that the subject cited industry was granted consent to establish vide no. CTE/Fresh/SAS/2019/9066547 dated 31.01.2019, which is valid upto 31.01.2020 for establishment of a brick kiln in an area measuring 10 Bigha, in the revenue estate of village SalempurNagal, Sub Tehsil Banur, SAS Nagar at Khasra Nos. 108/1 (2-0), 109/9 (3-0), 110 (3-0), 111 (2-0); vide no. 3837 DTP(P)/B-17 dated 18.12.2018, for the manufacturing of Brick/Tiles @ 50,000 Numbers/day, subject to certain conditions as mentioned therein.
Now, the industry has applied for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents. The industry has submitted latest CA certificate, wherein, the value of the fixed assets has been mentioned as Rs. 29.03 lacs as on 14.03.2019. The industry has deposited consent fee of Rs. 58,500/- (Rs. 29,000/- each on account of consent fee under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 500/- as application form fees) vide R. no. 84/4853 dated 18.03.2019. The consent fee deposited under both the Acts is adequate upto 31.12.2028 as per the revised fees structure dated 29/10/2018 (office order no. 524).
Accordingly, the BKO was visited by the AEE of this office on 19/03/2019 and observed that:
1. The industry has got constructed the brick kiln to induced draught technology and the industry has brick feeding/stacking inside the heating chamber and has not commissioned its unit.
2. The industry has constructed a chimney of height more than 100’ and the industry has provided monkey ladder and proper platform along with sampling arrangement.
3. The industry has stabilized the movement area with keri in its premises.
4. The industry has provided a septic tank to treat the wastewater being generated from the labour toilets and the treated domestic effluent will be discharged onto land for plantation.
5. The industry has not installed DG set of capacity 30 KVA at the site, which is equipped with canopy and a stack of adequate height.
6. The industry has installed pulverizer for the pulverization of coal and has built 3 no. coal storage yards at site.
7. The industry has now submitted completion and adequacy certificate duly issued by Punjab State Council for Science & Technology vide no. PSCST /CC/1195 dated 07/03/2019 and also submitted the approved layout plan/design of brick kiln.
8. The industry has planted fresh tree along the boundary wall of the project.
9. The industry is complying with the code of practice framed by the PPCB.
It is pertinent to mention here that as per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
In view of the above mentioned facts and CPCB directions, it is recommended that consent under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2028 subject to the suitable conditions and following special conditions:
1. The industry shall not use any other fuel in the brick kiln for burning purpose, except, pulverized coal.
2. The industry shall not use any illegal fuel at any stage of firing of the brick kiln.
3. The industry shall operate the brick kiln on induced draught Technology with Zig-Zag brick setting and shall not operate it on natural draught in any case.
4. The industry shall submit the air emission analysis report once in year from the Board’s lab/ Boards approved lab.
