Subject: Application for obtaining fresh of authorization under Bio-Medical Waste Management Rules, 2016 - M/s CHC Malaud, Payal, Ludhiana.
Reference: HCF's online application ID no. 25621818 dated 09/05/2024.
Earlier, the subject cited HCF has obtained authorization under Bio-Medical Waste Management Rules, 2016 vide no. BMW/Renewal/LDH1/2018/6965734 dated 12/02/2018 valid upto 31/12/2022 for 30 beds with special condition that the HCE/CBWTF shall discharge its effluent after treatment as prescribed under the Rules.
Now, the HCF has applied for obtaining fresh authorization under the provisions of the Bio-Medical Waste Management Rules, 2016 for 30 beds. The HCF has entered into an agreement with by M/s Medicare Environmental Management Pvt. Ltd., Ludhiana for collection, transportation, treatment and disposal of bio-medical waste generated by it. The agreement is valid for five years i.e. upto 31/03/2029.
The hospital was visited by undersigned on 20.06.2024 and observed as under:
1. The HCF was in operation and has capacity of 30 beds.
2. The HCF has made an agreement with the common facility M/s Medicare Environmental Management (P) Ltd., Ludhiana for lifting of its Bio-medical Waste.
3. The HCF is adopting the proper color-coding as per Bio-medical Waste (Management) Rules, 2016 & segregating its Bio-medical Waste as per Bio-medical Waste (Management) Rules, 2016.
4. The HCF has provided a needle shredder & sharp waste was handled in punctured proof container.
5. The HCF was maintaining record of BMW generation & the lifting of Bio-medical Waste by common facility M/s Medicare Environmental Management (P) Ltd., Ludhiana.
6. The liquid waste generated is treated with 10 % sodium hypo chloride solution & then discharged into sewer.
7. The HCF has installed ETP for treatment of waste water. But, same is yet to be commissioned.
8. No action is pending against the concerned healthcare facilities for violation of Bio/Medical Waste Management Rules, 2016, Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986.
The HWC has not deposited authorization fee under Bio Medical Waste Management Rules, 2016 due to non-availability of funds. As per Board’s letter no. 23951-53 dated 05.10.2023, the request made by PHSC matter was considered by the Government and directed the Board that "ਪੰਜਾਬ ਵਿੱਚ Public Healthcare facilities ਵਲੋਂ ਫੀਸ ਜਮ੍ਹਾਂ ਕਰਵਾਉਣ ਵਿਚ ਦੇਰੀ ਕਾਰਨ authorization ਨਾ ਰੋਕੀ ਜਾਵੇ ਅਤੇ ਇਨ੍ਹਾਂ Public Healthcare facilities ਨੂੰ ਇਸ ਸ਼ਰਤ ਤੇ authorization ਦਿੱਤੀ ਜਾਵੇ ਕਿ ਇਨ੍ਹਾਂ HCF ਵਲੋਂ ਫੰਡ ਉਪਲੱਬਧ ਹੋਣ ਉਪਰੰਤ ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਰੋਕਥਾਮ ਬੋਰਡ ਵਿਚ ਜਮ੍ਹਾਂ ਕਰਵਾਏ ਜਾਣਗੇ। "
The HCF is complying with provisions of Bio-Medical Waste Management Rules, 2016.
As per PPCB office order no. 379 dated 23.10.2023, it has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-medical Waste Management Rules, 2016 as amended up to date and subsequent amendments, if any.
Keeping in view of the above, it is recommended that authorization under Bio Medical Waste (Management & Handling) Rules, 2016 may be granted upto 30.06.2025 with special conditions as follows:
• The HCF shall deposit the authorization fee on availability of funds.
• The HCF shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-medical Waste Management Rules, 2016 as amended up to date and subsequent amendments, if any.
