File Note: It is intimated that the industry is medium scale orange category unit was granted authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 vide no. HWM/Fresh/FGS/2021/15357220 dated 03/06/2021 valid upto 30/09/2021 under the name of Mittal Ceramics for Generation, Collection, Storage, Disposal Cat. 35.1 @ 70 TPA and Cat 5.1 @ 0.020 Kl/Annum. The industry has been given personal hearing before the Worthy Chairman of the Board on 17/08/2022 u/s 5 of EPA Act 1986 for imposition of EC, wherein it was decided as under: 1. EC amounting to Rs. 4 lakhs shall be deposited by the industry within 15 days. 2. The industry shall maintain the record of hazardous waste category 35.1 of Schedule-I in proper manner and shall submit the same at Regional Office, Fatehgarh Sahib on regular basis. 3. The industry shall dispose of its waste category 35.1 to authorized re-cycler and will not depose off the same in illegal manner in any circumstances. 4. The Regional Office shall process the authorization application after deposition of EC. To verify the compliance of personal hearing the industry was visited by the AEE on 03/11/2023 and it was observed that: 1. Industry was not in operation and Sh. Sukhvir Singh manager of the industry informed that the industry does not operated in regular basis and has been operated only 3-4 days in week on demand. 2. The industry is engaged in the business of manufacturing steel ingots rolls using scrap as raw material. 3. The industry has installed induction furnace of Capacity 6 TPH and bag filter house installed as APCD. 4. The industry has installed Annealing furnace and furnace oil has been used as fuel and the industry has installed adequate stack height with it. 5. The industry has not deposit EC amount for Rs. 4.0 lac till date also. Now, the industry has applied for fresh authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for Generation, Collection, Storage, Transportation, Disposal Cat. 35.1 @ 20 T/Annum and Cat. 5.1 @ 0.020 KL/Annum. It is further intimated that the industry has now been purchased by M/s Evit Steels Pvt. Ltd. and operates only 3-4 days a week. Therefore, the industry has applied for Cat. 35.1 @ 20 TPA. Accordingly, to verify the compliance of personal hearing and the contents, the industry was visited by the undersigned on 14/06/2024 and it was observed as under: 1. The industry was not in operation due to disconnect the power supply. The power connection has been disconnected temporarily on13/06/2024 by PSPCL authority vide order no. 100025606127 dated 11/06/2024. 2. The industry has installed induction furnace of capacity 06 TPH and installed Bag filter house as APCD. 3. The industry is engaging in the manufacturing of Steel alloys/metal roll @ 72 MTD. 4. The industry made an agreement for lifting of its hazardous waste Cat. 35.1 with M/s Madhav KRG Environmental Solution Pvt. Ltd. 5. The industry has lifted its hazardous waste Cat no. 35.1 @ 6.830 MT vide manifest no. 571 dated 25/04/2023, 6.745 MT vide manifest no. 504 dated 21/02/2023 and 6.010 MT vide manifest no. 805 dated 13/10/2023 to M/s Madhav KRG Environmental Solutions Private Limited. 6. The industry has provided impervious storage room storage of hazardous waste. The capacity of storage room is sufficient to store hazardous waste for 2-3 years. 7. No water is used in the process, so no trade effluent will be generated. 8. The industry has provided septic tank for treatment of domestic effluent. 9. Presently, 1.5 Tons hazardous waste is lying stored in storage facility provided within the premises. 10. The industry has installed 1 no. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. 11. The industry has already provided danger sign on storage room & Environmental data Board near the main gate. 12. the industry has deposited the Environmental Compensation amounting to Rs. 4.0 Lakhs receipt no. 49/5532 dated 19/06/2024 (cheque no. 378361 dated 14/06/2024), payable to the Environmental Engineer, Punjab Pollution Control Board. 13. The industry has maintained the record of hazardous waste category 35.1 of Schedule-I in proper manner. In view the above, it is recommended that fresh authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for generation, collection, storage, transportation & disposal of hazardous waste Cat. 35.1 @ 20 T/Annum and Cat. 5.1 @ 0.020 KL/Annum may be granted to the industry upto six months as recommended under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with suitable conditions and with special conditions: 1. The industry shall dispose off its Hazardous waste to the authorized recycler /re-processor having valid Registration Certificate-cum-Pass Book from Punjab Pollution Control Board and valid authorization of the Board under the said Rules and 'consents to operate' under the Water Act, 1974 and the Air Act, 1981. 2. The industry shall apply for authorization before the expiry of previous authorization of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 3. The industry shall handle the Hazardous Waste(s) strictly in accordance with the provisions of the Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board / Ministry of Environment & Forests and Climate Change, New Delhi. 4. The occupier generating hazardous waste/operator of a facility for collection and storage of hazardous waste shall maintain records of such operations in Form-3. 5. The occupier/operator of a facility shall send annual returns to the Board in form-4 on or before 30th day of the June following to the financial year to which that return relates. 6. The Authorized person shall report, about the accident which occurs at the hazardous waste storage/treatment site immediately to the Board. 7. An occupier who is generating hazardous waste shall store his waste category wise on site in environmentally sound manner till its treatment. 8. An occupier /generator shall not store hazardous wastes in open ground. It must be stored in an isolated site away from plant operational area. 9. The storage tank/container of the hazardous wastes should be in good condition and made of (or lined with) an appropriate material which does not react with the waste contained in it and can withstand the physical and environment conditions during storage and handling. 10. The occupier generating hazardous waste shall provide the required safety devices like safety mask, goggles, hand-gloves, gum boots etc to the workers for handling the hazardous waste. The occupier shall impart training to the personnel/workers for handling and storage of hazardous wastes. 11. There should be sufficient & efficient provisions to avoid under ground water contamination from waste storage of hazardous wastes 12. The occupier shall be responsible for any damage of life/or property during storage of his waste and will obtain Public Liability Insurance, wherever applicable. 13. The occupier and operator of a facility also be liable to reinstate or restore damaged or destroyed elements of the environment at his cost, failing which the occupier or the operator of a facility, as the case may be, shall be liable to pay the entire cost of remediation or restoration and pay in advance an amount equal to the cost estimated by the State Pollution Control Board.
