File Note: Sir, the Project Proponent (PP) was issued show cause notice for violation of provisions of Hazardous & Other Wastes (Management & Transboundary Movement)Rules, 2016 with an opportunity of personal hearing before Worthy Chairman of the Board on 22.02.2023 in which following decisions were taken:- 1. The industry shall maintain record w.r.t. generation, storage and disposal of hazardous waste on regular basis. 2. The industry shall operate compost pits in scientific manner so that there should not be any problem of foul smell in the area. 3. The Environmental Engineer, Regional office-2, Ludhiana shall visit the industry, process authorization application on merits and submit further recommendation in the matter. In compliance of the decision No. (3) above, authorization under the Hazardous & Other Waste (Management and Transboundary Rules), 2016 was issued valid upto 07.06.2024 for generation, storage and disposal of Hazardous Waste of Cat.No. 5.1 (Used/Spent Oil) @ 3 KL/Annum. To verify the compliance of the decisions of personal hearing dated 22.02.2023, (pending in e-noting) the project site was visited by RO on 30.01.2024 and it was reported as under:- 1. The PP is maintaining the record of Hazardous Waste Generation, Storage and its Disposal. 2. No composting pits observed during visit. 3. It has provided Hazardous waste storage room to store the hazardous waste of category no. 5.1 of size 14’ X 11’ X 9’ in which Appox. 230 Lts. of spent oil was lying stored. It has provided Danger Sign Board outside the Hazardous waste storage room. 4. It has made an agreement for lifting of Hazardous waste of category no. 5.1 with the re-processor i.e. M/S Mahadev Petrochemicals, D-116, Focal Point, Mandi Gobindgarh on 06.02.2023 which is valid upto 05.02.2025. The report was sent to Competent Authority of the Board through e-noting file No. 20717256. RO further reported that PP was issued notice u/s 33-A of the Water Act, 1974 alongwith show cause notice for revocation / cancellation of consent to operate under the Water Act, 1974 and the Air Act, 1981 with hearing before the Chairman of the Board on 27.03.2024 among the other decisions following decisions were also taken:- 1. The industry shall not operate Palm Oil processing plant without prior permission of the Board. 2. The industry shall not store any hazardous waste in its premises without obtaining prior permission from the Board. 3. The industry shall submit a Bank Guarantee of Rs. 20 lacs, within 15 days, as an assurance to comply with the provisions of the Water Act, 1974, Air Act, 1981 and Hazardous and other Waste Rules, 2016, out of which Bank Guarantee of Rs. 05 lacs be encashed. 4. The Environmental Engineer, Regional office-2, Ludhiana shall visit the premises of Parkash Compost to verify the status of vermin compost of dates being got done by the industry, within 15 days. He shall also visit the premises of the industry within 15 days to verify the records as well as various compliances made by it at site and shall send further recommendation in the matter. 1. In this regard PP has submitted that crude Palm oil facility is only for temporary storage for transit from rail to road. This is not a processing unit. 2. The PP has submitted an undertaking that its Palm Oil storage facility is currently not in operation and shall remain non-operational without prior permission of the Board. During visit no activity observed in this section. 3. The PP has made a request to the Board for waive off the Bank Guarantee vide its letter dated 16.05.2024, which is being dealt separately. Now, the PP has applied for varied authorisation under the Authorization under the Hazardous & Other Waste (Management and Transboundary Rules), 2016 for Cat.No. 5.1 (Used or Spent oil) @ 6 KL/Annum and Cat.No.5.2 (Wastes or residues containing oil) @ 0.132 T/Annum alongwith required documents. To verify the compliance of the decisions of said personal hearing, the project was visited by RO on 12.06.2024 and it was reported as under:- 1. During visit project was in operation. 2. It has made an agreement for lifting of Hazardous waste of category no. 5.1 with the re-processor i.e. M/S Mahadev Petrochemicals, D-116, Focal Point, Mandi Gobindgarh on 06.02.2023 which is valid upto 05.02.2025. 3. It has made an agreement for lifting of Hazardous Waste of category No. 5.2 with M/S Bharat Oil Co., (I) Regd., E-18, Site-IV, Sahibabad Industrial Area, Ghaziabad, (UP) on 06.06.2024. 4. It has provided Hazardous waste storage room to store the hazardous waste of category no. 5.1 of size 14’ X 11’ X 9’ in which Appox. 17 Lts. of spent oil was lying stored and Hazardous waste of category no. 5.2 is yet to be started store. 5. It has provided Danger Sign Board outside the Hazardous waste storage room. 6. It has provided environmental data board of size 6’ X 4’ at the main gate of the industry. 7. Now, it has provided 2 vermi composting pits as per decision of personal hearing dated 22.03.2023 and same were in operation. 8. Now, the industry is complying with the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 9. The details of visit to M/S Parkash Compost, Village Mathiana, Banur Distt. Mohali is as under:- (i) RO visited the premises of Parkash Compost, Village Mathiana, Banur Distt. Mohali to verify the status of vermi compost of dates being got done by the industry and it has been observed that industry is having 56 Vermi composting pits having appox. capacity 2 Ton capacity and all pits were filled with material. It has 2 Deep well to prepare the slurry of raw material and both were filled with slurry. Sh. Asseem, owner of the industry informed that composting process is already in process since receipt of the material and entire process composting of dry dates will be completed by the end of August, 2024. As per record produced by the PP, the Dry Dates were dispatched to M/S Parkash Compost, Village Mathiana, Banur Distt. Mohali and M/S Parkash Compost, raised the bills to M/S Pristine Mega Logistics Pvt. Ltd. Hence, the PP has disposed off its dry dates with Scientific manner. RO recommended that the authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 may be granted to the Project Proponent for one year with usual conditions and with the special condition that :- (a) The industry shall not operate Palm Oil processing plant without prior permission of the Board. (b) The industry shall not store any hazardous waste in its premises without obtaining prior permission from the Board. (c) The industry shall bound to comply with the decisions of Competent Authority of the Board regarding submission as well as encashment of Bank Guarantee. Building construction and area development projects. In view of the above, it is recommended that the authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 may be granted to the Project Proponent for one year with special condition as proposed by RO, please.
