File Note: The industry is a large scale unit, which was granted authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016, issued vide no. HWM/renew/LDH1/2024/24968138 dated 19/04/2024 valid upto 30/06/2024 for generation of hazardous waste of category no. 35.3 @ 245 T/annum, Category 5.1 @ 0.5 KL/annum, Category 33.1 @ 0.6 TPA and Category 33.1 @ 3000 Nos/day for collection, storage & disposal of hazardous waste. Earlier, the industry was given personal hearing given before the Chairman of the Board on 15.03.2024 w.r.t. show cause notice for revocation of consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 alongwith notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974, wherein, it was decided as under: 1. The industry shall comply with all the violations stated as above, immediately. 2. The industry shall continue to operate its pollution control devices regularly and efficiently so as to achieve the prescribed standards. 3. The industry shall immediately finalize the order for installation of Zero Liquid Discharge (ZLD) plant. 4. The industry shall submit Progress Evaluation and Review Technique (PERT) chart for installation of ZLD plant, within 15 days. 5. The industry shall install and commission ZLD plant by 31.05.2024 and shall complete its stabilization by 30.06.2024. 6. The industry shall submit Bank Guarantee of Rs. 50 lacs, within 15 days, as already imposed during hearing dated 16.06.2023 as assurance that the upgraded ETP based on ZLD technology will be installed and commissioned by 30.06.2024. 7. The Environmental Engineer, Regional Office-2, Ludhiana shall monitor progress and submit compliance report of hearing decisions alongwith recommendations in the matter, accordingly. Now, the industry has applied for obtaining renewal of authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for generation, collection, storage & disposal of hazardous waste category no. 35.3 @ 245 T/annum, Category 5.1 @ 0.5 KL/annum, Category 33.1 @ 0.6 TPA and Category 33.1 @ 3000 Nos/day alongwith requisite documents through OCMMS. Further, the industry has entered into an agreement with TSDF Nimbuan for shifting of its hazardous waste in the year 2008 for hazardous waste category no. 35.3 and with M/s B.P. Mahaveer Plastic and Scrap Co. for shifting of its hazardous waste category no. 33.1 on 16.02.2024. It has also submitted an agreement with M/s Satkar Oil Company, Focal Point, Ludhiana for shifting of its hazardous waste category no. 5.1. The industry was visited by the undersigned on 25.04.2024 and it was observed as under: 1. The industry was in operation during visit and engaged in dyeing and washing of Fabric/Fiber/Yarn. 2. The industry has also installed Air Compressor Atlas (9 No.), R F Dryer (5 No.), 1 No. Stentor (06 Chambers), Open Width Compactor (2 No.), 1 No. Tubular Compactor, Fabric Dryer (3 No.), Fiber Dryer (2 No.), Washing Machines (14 No.), Raising Machines (3 No.), D.G. Generator (3 No.), Fabric Inspection Machines (6 No.), Fabric Palti Machines (2 No.), Fiber Opener (2 No.), 1 No. Thermopac (20 Lac Kcal), 1 No. Open Squeezer 3. The industry has installed an ETP of capacity 5000 KLD for treatments of its trade effluent and domestic effluent. The components of the ETP are Equalization Tank - Flash Mixer - Primary Clarifier Aeration Tank - Secondary Clarifier – MGF – ACF - Final Outlet. 4. The industry is maintaining proper records of ETP water meters and separate energy meter. 5. The treated trade effluent & domestic effluent is being discharged into sewer after treatment. 6. The industry has installed OCEMS for pH, TSS, BOD & COD at the final outlet of ETP and same was in operation during visit. 7. The treated effluent samples were collected from the outlet of ETP during visit on 25/04/2024 and as per analysis report, all the parameters are within the prescribed limits of the Board. 8. Stack samples was also collected during visit on 19/10/2023 from port hole on stack after APCD of Thermax boiler @ 30 TPH and as per analysis report, SPM was reported as 46 mg/Nm3 against the prescribed standards. 9. The industry has maintained Hazardous Waste room for ETP Sludge, Empty Containers and user oil. 10. The industry has provided Board showing danger sign and category of hazardous waste on room meant for hazardous waste storage. Category 35.3 (Chemical sludge from waste water treatment) It has signed an agreement with TSDF Nimbuan for disposal of hazardous waste of category 35.3. Lastly, it has disposed off its hazardous waste of category 35.3 @ 12380 Kgs vide manifest no. 50202 dated 22.06.2024 and its current storage is 17375 Kgs. Category 5.1 (Used or spent oil) It has signed an agreement with M/s Satkar Oil Company, Focal Point, Ludhiana for disposal of hazardous waste of category 5.1. Lastly, it has disposed off its hazardous waste of category 5.1 @ 315 ltr vide manifest no. 421 dated 20.03.2024 and its current storage is 65 ltr. CAT. 33.1 (Empty barrels/containers/liners contaminated with hazardous chemicals /wastes) It has signed an agreement with M/s B.P. Mahaveer Plastic and Scrap Co. for disposal of hazardous waste of category 33.1. Lastly, it has disposed off its hazardous waste of category 33.1 @ 250 number vide manifest no. 418 dated 28.05.2024 and its current storage is 274 number. 11. The industry has not finalized the order for installation of Zero Liquid Discharge (ZLD) plant. 12. The industry has not submitted Progress Evaluation and Review Technique (PERT) chart for installation of ZLD plant till date. 13. The industry has not installed ZLD plant till date. 14. The industry has not even submitted Bank Guarantee of Rs. 50 lacs as already imposed during hearing dated 16.06.2023 as assurance that the upgraded ETP based on ZLD technology will be installed and commissioned by 30.06.2024. 15. The competency to grant the authorization is Hon’ble Chairman of the Board. In view of the above, it is recommended that Show cause notice before refusal of authorization under Hazardous & Other Wastes (Management Transboundary Movement) Rules, 2016, may be issued with an opportunity of personal hearing before the Competent Authority of the Board.
