Sir, details/facts/report/recommendations alongwith legal opinion given by Sh Amrik Singh, SLO of the Board is mentioned in the note of AEE....
The said project is an Ayurvedic Panchkarma centre with no generation of any
category of waste defined in Bio Medical Waste Management Rule, 2016....
The case was forwarded to Zonal Office-I Patiala with the recommendations to
consider the case under green category and the authorization under Bio
Medical Waste Management Rules, 2016 may be granted to the panchkarma
centre upto 30.04.2029. However, the Zonal Office has back referred the case
to this office to decide the case as per prevailing policy of Board......
Accordingly, it was decided to take legal opinion from Senior law Officer of the Board to decide
the case...
Now, Senior Law Officer of the Board has
opined that the authorization may be granted to the HCF with the condition
that the authorization granted under the Bio Medical Waste will only be valid
from pollution angle and shall not be valid for any other purpose. However, the
Board may obtain an undertaking from the owner of Yukti Herbs that the
Health Care Facility shall not offer or undertake any other medical facility for
the diagnosis, treatment or immunization of human beings including research
which may lead to the generation of bio medical waste...
HCF has given undertaking as per above..
Submitted as per above report/recommendations given by AEE, it is recommended that the authorization under Bio Medical Waste Management Rules, 2016 may be granted to the panchkarma centre under Green category upto 30.04.2029 subject to suitable conditions and special condition as proposed by AEE in his note above please.. |
