File Note: It is submitted that the RO has submitted report regarding the application filed by the unit. After perusing the report sent by RO, the following points were noted: - It is submitted that the unit was earlier granted authorization under the Hazardous Wastes as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 vide no. HWM/renew/PTA/2023/24200392 dated 06/12/2023 having validity upto 30/09/2024 for collection, storage & disposal of hazardous waste category 5.1 @ 0.110 KL/Annum, under the name & style of M/s Jyoti Threads (India) Limited. - Now, the unit has applied for authorization for generation, collection, storage and disposal of hazardous waste of category 5.1 @ 0.110 KL/Annum under Hazardous & other Waste (Management, & Transboundary Movement) Rules, 2016 with requisite documents, under the name &Style of M/s Jyoti Threads (India) Private Limited. - The industry has submitted compliance of the previous authorization, form 3, form 4, plan of building etc. The industry has also submitted request letter for rectification that it has by mistake entered qty. of DG set waste oil to be generated in the unit @ 0.1 KL/year instead of actual generation of 0.11 KL/year as earlier granted by PPCB. So, you are requested to rectify the above said error while processing our case. - The industry was visited by the officers of Regional Office on 29.05.2024 and it was observed as under: 1. The industry was in operation. 2. The industry has provided an impervious room of size 12'x4'x15' for the storage of hazardous waste. 3. During visit it was observed that the quantity of stored waste oil in the HWM room was nil. The representative of the industry has informed that the due to proper and regular supply of power, the operation of DG sets is less and servicing of the same yet to be done. 4. The industry has installed DG set of capacity 750 KVA equipped with canopy and stack of adequate height. The industry is complying with the conditions of authorization granted to it under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 by the Board. - The RO has recommended that the authorization may be granted to the industry under the Hazardous & other Waste (Management, & Transboundary Movement) Rules, 2016 upto 30.09.2028 for collection storage and disposal of used oil Category 5.1 @ 0.110 KL/Annum with suitable conditions. In consideration of the above facts and the report/ recommendations earlier sent by the RO; if approved, the authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for generation, storage & disposal of hazardous waste HW Cat. 5.1 @ 0.11 KLA, be granted to the industry under the name & style of M/s Jyoti Threads (India) Private Limited, upto 31.03.2029 (consonant to validity of CTOs), subject to suitable general conditions and the following additional conditions: 1. The industry shall not generate/ store/ collect/ dispose any other category of hazardous waste from its premise, except the category of hazardous waste(s) for which it has been granted this authorisation under the HWM Rules, 2016. 2. The industry shall install online display board (digital type) in accordance with the Board’s letter no. 17852-65 dated 14.08.2020 within one month (if not already provided) and submit compliance to the Board within 7 days, thereafter. 3. The industry shall dispose of its hazardous waste(s) to the authorized unit / recycler/ co-processor facility/ TSD Facility having valid Registration Certificate-cum-Pass Book from Punjab Pollution Control Board / Central Pollution Control Board and valid authorization of the State Board under the said Rules and 'consents to operate' under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 and authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, under proper manifest and shall maintain proper record in this regard, at all times. 4. The industry shall get the agreements executed with the facilities/ recyclers before expiry of the same and thereafter apply for renewal of authorization under the HWM Rules, 2016. 5. The industry shall store its hazardous wastes generated from different manufacturing activities/ otherwise, within its premises in an environmentally sound manner as per provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. Further, the industry shall ensure regular lifting of hazardous waste and also ensure that the quantity of hazardous waste generated per year shall not be stored beyond 90 days (extendable upto 180 days) in its premises at any time. 6. The industry shall handle the hazardous waste(s) strictly in accordance with the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board / Ministry of Environment & Forests and Climate Change, New Delhi. 7. In case, the industry fails to comply with the above conditions of authorization as well as provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and/or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, the Board shall be constrained to take action against the industry under the provisions of the Pollution Control Laws.
