Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.07.2024 w.r.t. show cause notice for refusal of authorization under Hazardous Waste (Management Handling & Transboundary Movement) Rules, 2016 to M/s Fastway Bicycles, Industrial Area - C, Near Dasmesh Kanda, Dhandari Kalan, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry has applied for fresh authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 for Category 21.1 (Process wastes, residues and sludges) @ 0.060 Ton/Annum, Category 12.5 (Phosphate sludges) @ 1.0 Ton/Annum.
On perusal of application of the industry, following observations has been made:-
1. As per MSME certificate of the industry, date of commissioning is 01.01.2022 and the industry is in operation since 01.01.2022.
2. As per record submitted by the industry, the generation of hazardous waste category 12.5 is 1.2 Ton in the year 2023-24 & 1.140 Ton in the year 2022-23. However, the industry has applied for authorization for hazardous waste category 12.5 @ 1.0 Ton/Annum. The industry has applied for authorization for less quantity of hazardous waste as compared to actual generation of hazardous waste.
In view of the above, the industry was issued show cause notice for refusal of authorization under Hazardous Waste Rules, 2016 with hearing before the Senior Environmental Engineer of the Board on 03.07.2024.
Sh. Sabhajeet Pandey, Representative of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that they have entered the quantity 1.0 mt against maximum generation of hazardous waste 1.2 MT in 2023-24 by mistake. In future this would not be more than 1.5 MT.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The present application for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 be returned to the industry.
2. The industry shall re-apply for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 for actual generation of hazardous waste.
3. Environmental Engineer, Regional Office shall verify the submission made by the industry and process authorization application, accordingly.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
