File Note: Sir, the industry has submitted the reply that the CPCB has prescribed SOP for the following; a) Utilisation of metal and metal bearing wastes (Tin/Tungsten/Vanadium/Tanalum/Niobium scrap) for recovery of metal salts and alloys b) Utilisation of ETP sludges for recovery of Ni, Cr, etc. c) Utilisation of Vanadium sludge The copies of the said SOPs has also been attached. However, the industry does not meet with the guidelines/SOPs mentioned for vanadium sludge. In view of above, if may approve, the industry may be granted authorization and passbook under Rules, 09 of the Hazardous & Other Wastes (Management & Transboundary movement) Rules, 2016 for Cat. 5.1 @ 0.1 T/Annum, Cat. 7.2 @ 150 T/Annum, Cat. 35.1 @ 0.7 T/Annum, Cat. 35.3 @ 0.06 T/Annum, Cat. 51 @ 1.5 T/Annum for 5 years with usual conditions and special conditions that: - 1. The industry shall store its hazardous waste generated within its premises in an environmentally sound manner as per provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 2. The industry will only lift the hazardous waste mentioned in the SOP (standard operating procedure) for utilization of metal and metal bearing wastes (Tin/Tungsten/Cobalt/Vanadium/Tantalum/Niobium Scrap) for recovery of metal salts/alloys from other industries for metal recovery and Utilisation of ETP sludges for recovery of Ni, Cr, etc.. 3. The industry shall dispose off its hazardous waste category no. 5.1 to the authorized unit/ recycler/reprocessor having valid Registration Certificate-cum-Pass Book from Punjab Pollution Control Board/Central Pollution Control Board and valid authorization of the State Board under the said Rules and 'consents to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and authorization under the Hazardous and Other Wastes (Managementand Transboundary Movement) Rules, 2016. 4. The industry shall dispose off its hazardous waste generated in category no. Class C: 51 & 35.3 to the Common Hazardous Waste Treatment & Disposal Facility as per provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 5. The industry shall either dispose off its hazardous waste generated in category no. 35.1 to M/s Madhav KRG Ltd., Mandi Gobindgarh or to the Common Hazardous Waste Treatment & Disposal Facility at Nimbuan, only; as per provisions of theHazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 6. The industry shall handle the hazardous waste(s) strictly in accordance with the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board/ Ministry of Environment & Forests and Climate Change, New Delhi. 7. The industry shall comply with the SOP (standard operating procedure) for utilization of metal and metal bearing wastes (Tin/Tungsten/Cobalt/Vanadium/Tantalum/Niobium Scrap) for recovery of metal salts/alloys and SOP for Utilization of ETP Sludge (generated from pickling process/ wastewater treatment) for manufacturing of Red/Chromium/Nickel Oxide & Gypsum in true letter & spirit. 8. The industry shall ensure regular lifting of hazardous waste and also ensure that the quantity of hazardous waste generated per year shall not be stored beyond 90 days (extendable upto 180 days) in its premises at any time. 9. The industry shall handle the hazardous waste(s) strictly in accordance with the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board/ Ministry of Environment & Forests and Climate Change, New Delhi. 10. In case the industry fails to comply with the above conditions of authorization as well as provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and/or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, the Board shall constrained to take action against the industry under the provisions of the Pollution Control Laws. *Competency Hon’ble Chairman of the Board
