It is submitted that HCF was granted authorization under Bio-Medical Waste Management Rules, 2016 vide no. BMW/Fresh/SAS/2024/24794558 dated 05.02.2024 subject to certain terms and conditions mentioned therein.
Now, the HCF has applied for fresh of authorization under the Bio-Medical Waste Management Rules, 2016 for non bedded clinic alongwith requisite documents due to change of name of Occupier from Aakanusha Singh to Rakesh Sharma.
As per H.O.Patiala Office Order No. EPA/2018/No. 04 dated 10.04.2018 the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 20 beds/dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and various rules made there-under.
In light of above office orders, the inspection is not required as the HCF is clinic. The brief detail of the case applied by the healthcare facility is as under:-
1. The HCF has submitted the Location Plan of the HCF.
2. The HCF has made an agreement with M/s Rainbow Environments Pvt. Ltd., Village Balyali, Tehsil Kharar valid upto 19.07.2026 for clinic.
3. As per record of this office, no action is pending against the health care facility for violation of the (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986.
Further, the HCF has submitted a request letter in which, it has been mentioned that:
“We are applying for the authorization of Bio Medical Waste in the name Crayons Superspeciality Clinic. Earlier Bio Medical Authorization was granted vide authorization no. BMW/Fresh/SAS/2024/24794558 dated 05/02/2024 but now the authorised person name is changed i.e. Mr. Rakesh Sharma (Owner/Proprietor) now we have applied for a new authorization with occupier name Mr. Rakesh Sharma so please grant our revised new authorization of Bio Medical Waste.”
It is intimated that Board has issued partial modification to earlier Board’s order no. 468 dated 31.08.2021, vide its office order no. 601 dated 16.12.2021 has decided that the HCF upto 50 beds which are discharging there liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plant have been installed, shall be granted consents/ authorization by Punjab Pollution Control Board without installation of individual ETPs, as an interim arrangements/ measures, subject to condition that the HCF shall ensure to comply with the effluent standards as notified and Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any. However, no specific period mentioned in the said orders.
Further, the HCF has deposited Rs. 1000/- (Onetime fee) vide UTR. No. MAHBH24023172881 dated 23.01.2024 under Bio-Medical Waste Management Rules, 2016 fee as per Board’s office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023.
In view of above, if may approved, one time authorization under the Bio-Medical Waste Management Rules, 2016 may be granted to the HCF subject to the suitable conditions and following additional conditions as under:-
1. This authorization is issued in supersession to earlier authorization no. BMW/Fresh/SAS/2024/24794558 dated 05.02.2024 under the Bio-Medical Waste Management Rules, 2016.
2. This authorization is valid only for non-bedded clinic.
3. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
4. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
5. The HCF shall obtain other statutory approvals required from other departments, if any.
6. The HCF shall comply with the Board’s office order no. 601 dated 16.12.2021 and its subsequent amendments, if any.
