• The Punjab Pollution Control Board vide its office letter no. EPA/2018/no.-04 dated 10.04.2018 in order to ensure ease of doing business in the small HCF in the state of Punjab, the procedure for obtaining authorization under Bio Medical Waste Rules, 2016 has been simplified asunder:
• The documents required to be submit along with application for authorization under the Bio-Medical Waste Management Rules, 2016 Rules, 2016 for HCF upto 20 beds/ dental chair will asunder:
• Location plan / google location plan of HCF.
• Copy of agreement of CBWTF.
• Self declaration regarding compliance of BMW Rules.
• Copy of manifest of lifting of waste by CBWTF operators for 7 days pertaining to previous one month.
• The authorization (fresh / renewal) under the BMW Rules, 2016 applied by the HCF upto 20 beds / dental chairs will be granted by the concerned Regional Office within 7 days on receipt of complete application without making inspection of those HCFs. However the concerned Regional Office shall ensure that no action is pending against the concerned HCF for violation of the BMW Rules, 2016, Water Act, 1974, Air Act, 1981, Environment Protection Act, 1986 and various rules made there under.
• After grant of authorization, randomly selected 10% HCFs shall be visited by the Regional Office within next 3 months to check compliance the provisions of BMW Rules, 2016.
• It is pertinent to mention that the Competent Authority vide order no. 468 dated 31.08.2021 has decided that the authorization under the Bio-medical Waste Management Rules, 2016 as amended in 2018 and consents to operate under the Water (Prevention and Control of Pollution) Act, 1974/ Air (Prevention and Control of Pollution) Act, 1981 may be granted to all the bedded HCEs located in town and cities and outside by bifurcating the facilities where terminal STPs have been installed/yet to be installed up to 31.03.2022, subject to the following conditions:-
• The HCEs will get effluent sample (combined liquid and domestic effluent) analysed from an approved lab of the Board by 31.01.2022.
• If the sample fails to achieve the prescribed standards as per Schedule-II of the BMW Rules, 2016 as amended in 2018 and 2019, HCE will install appropriate and adequate system to achieve the prescribed standards by 31.03.2022.
• Thereafter, vide Board’s order no. 379 dated 27.10.2023 the Competent Authority of the Board has decided that HCFs upto 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents/ authorization by Punjab Pollution Control Board without installation of individual ETPs, as an interim arrangement, subject to the condition that HCF shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-medical waste Management Rules, 2016 as amended up to date and subsequent amendments if any.
• The HCF was granted one time authorization under Bio Medical Waste Management Rules, 2016 vide no. BMW/Renewal/LDH3/2018/7314255 dated 26/10/2020 for 08 Beds.
• Now, the HCF has applied for fresh authorization under the Bio- Medical Waste (Management) Rules, 2016 through OCMMS for 04 beds with categories yellow, red, white (Translucent) and blue of the said rules. The HCF has submitted copy of an agreement signed with common facility of M/s Medicare Environmental Management Pvt. Ltd., Tajpur Road, District Ludhiana, dated 01.05.2024 authorized for 03 beds, wherein MEMPL has under taken the liability of collection, transportation and treatment / disposal of Bio-Medical Waste generating from the HCF. The agreement is valid upto 31.03.2029.
• The HCF has deposited Rs. 5000/- vide UTR. No. N183243123094784 dated 01.07.2024 under Bio-Medical Waste Management Rules, 2016 fee as per Board’s office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023. The total fee deposited by the hospital is adequate upto 31.12.2027.
• The in-charge of HCF has submitted a self declaration regarding treatment of liquid bio medical waste with sodium hypochlorite solution and to the effect that the HCF has complied with provisions of the Bio Medical Waste Rules, 2016.
• The HCF has submitted copy of record for bio medical waste maintained by it and annual report for previous year regarding the categories & quantities of bio medical wastes handled during the year.
• As per record file of HCF, no action is pending against the concerned HCF for violation of the BMW Rules, 2016, Water Act, 1974, Air Act, 1981, Environment Protection Act, 1986 and various rules made there under.
Thus, HCF is complying with the provisions of the Bio-Medical Waste (Management) Rules, 2016.
Keeping in view of above, if approved, authorization under the Bio-Medical Waste (Management) Rules, 2016 may be granted to the HCF for 04 beds for categories Yellow {(Chemical liquid Waste), (Human Anatomical Waste, Chemical Solid Waste, Microbiology, Biotechnology etc.)}, Red, White (Translucent), Blue of the rules for period upto 31.12.2024 subject to the suitable conditions along with special condition that:
i. This BMW authorization is valid for 04 beds only. The HCF will apply for fresh authorization if it increased its bed capacity.
ii. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same and intimate to the Board.
iii. The HCF shall install ETP-cum-STP for treatment of liquid waste from its premises.
iv. The HCF shall make sincere and concrete efforts and submit PERT chart to the Board office, regarding the installation of ETP-cum-STP to achieve the effluent standards prescribed under the Bio Medial Waste Management Rules, 2016 as amended from time to time.
v. The HCF will apply for consents of the Board under Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and under Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987.
vi. The HCF shall obtain other statutory approvals required from other departments, if any.
