It is submitted that the HCF was earlier granted authorization under Bio Medical Waste Management, Rules, 2016 vide no. RO/FZK/BMW/2014-17/Revised- dated 28.07.2014 for operation of HCF for bed capacity of 9 beds, valid upto 31.03.2017 with conditions mentioned therein.
Now, the HCF has applied for obtaining fresh authorization under the Bio Medical Waste Management Rules, 2016 for bed capacity @ 5 numbers, detail of case is as under:
• The HCF has submitted copy of an agreement with common facility of M/s Medwaste Solutions Pvt. Ltd., authorized by the Board with validity upto 20.02.2026 of bed capacity 5 beds.
• The HCF has already deposited authorization fee of Rs. 2000/- vide UTR / Ref. No. 178629140 dated 24.06.2024, which is valid upto 31.12.2024 under Bio Medical Waste Management Rules, 2016.
• The HCF has undertaking, stating that the HCF is 5 bedded hospital and is treating its liquid waste generated from the hospital using sodium hypochlorite solution and discharge into MC sewer and further has given assurance that it shall always comply with the effluent standards as Prescribed by MOEF for discharging of Hospital effluent
• The HCF has submitted copy of sewerage receipt issued by Municipal Corporation, Abohar as proof regarding valid sewage connection.
The Board vide letter no. HQ-3/EPA/2022/393-408 dated 06.06.2022 and CPCB letter no. B-31011/BMW(58.II)/2022/WMD-I dated 12.04.2022, states as under:
"As per said clarification non-bedded Healthcare Facilities (HCFs) may not necessarily need to install Effluent Treatment Plant and as per Bio Medical Waste Management Rules, 2016 they are required to dispose infectious liquid wastes only after treatment by disinfection as stipulated under Schedule II(6) of said Rules. Further, bedded HCFs are required to comply with the standards prescribed for liquid waste under Schedule-II of the Bio Medical Waste Management Rules, 2016. In case, wastewater is discharged into a public sewer connected to terminal sewage treatment plant, the bedded HCFs are required to meet general standards as notified under the Environment (Protection) Act, 1986."
The HCF is discharging its wastewater into MC sewer of Abohar town. MC Abohar has installed and commissioned terminal STP.
Now, the Board vide office order no. 379 dt. 23.10.2023 has decided as under:
"that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPS, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio Medical Waste Management, Rules, 2016 as amended upto date and subsequent amendments if any."
As per Board's office order no. EPA/2018/04 dated 10/04/2018, the authorization (Fresh / Renewal) under the Bio Medical Waste Management Rules. 2016 applied by the Health Care Facilities upto 20 beds / Dental chairs will be granted by the concerned Regional office within 07 days of receipt of complete application without making inspection of Health Care Facilities.
As per the office order no. EPA/2017/No. 5261-86 dated 15/12/2017 the competency of upto 50 beds HCEs and Labs and Blood Banks, Pathological Lab, Veterinary Institutions / Animal House etc lies with the Environmental Engineer of the Regional Office's.
In view of above, if approved the authorization for bed capacity of 5 no. beds under the Bio Medical Waste Management Rules, 2016 may be granted upto 31.12.2024 subject to the same conditions and following additional conditions:
1. The HCF shall submit effluent analysis report from Board's lab within this period to get the further extension in the validity of authorization.
2. The HCF shall apply for obtaining Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 within 15 days.
3. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
4. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
5. The HCF will apply for fresh authorization if it increases its bed capacity.
6. There is no claim of continuation of HCF in present premises on the basis of this consent / authorization. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency.
