It is submitted that the industry has applied for obtaining fresh of authorization under Bio Medical Waste Management Rules, 2016 for non-bedded facility being operated in its premises.
The industry has deposited one time authorization fee of Rs. 1,000/- vide UTR. No. N179243114125194 dated 27.06.2024 as BMW fees.
As per H.O. Patiala Office Order No. EPA/2018/No. 04 dated 10.04.2018 the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 20 beds/dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and various rules made there-under.
In light of above office orders, the inspection is required as the healthcare facility is zero bedded capacity. The brief detail of the case applied by the healthcare facility is as under:-
1. The industryhas submitted the Location Plan of the HCF.
2. The industry has submitted latest manifest slips for lifting of bio-medical waste.
3. The industry has made an agreement with M/s Rainbow Environments Pvt. Ltd., Village Balyali, Tehsil Kharar on 25.04.2023 having validity upto 24.04.2026 for lifting of bio-medical waste.
4. As per record of this office, no action is pending against the health care facility for violation of the Bio-Medical Waste Management Rules, 2016.
5. As per record of this office, no action is pending against the health care facility for violation of the (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986.
Keeping in view of above, if approved, one-time authorization under Bio-Medical Waste Management Rules, 2016 may be granted to the industry with suitable conditions and with special conditions that: -
1. This BMW authorization is valid for operating a non-bedded facility. The industry will apply for fresh authorization if it installs a bedded facility in its premises.
2. The industry will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same.
3. The industrywill submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
4. The industry will maintain proper record of generation and lifting of bio-medical waste.
5. The industry shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
6. The industry shall obtain other statutory approvals required from other departments, if any.
