File Note: It is submitted that the HCF was granted authorization under the Bio-Medical Waste Management Rules, 2016 vide no. BMW/Renewal/SGR/2024/24053428 dated 09.01.2024 valid upto 30.06.2024 for 7 beds capacity, subject to certain conditions mentioned therein alongwith special condition that: - "1. This BMW authorization is valid for 7 Beds only. HCF will apply for fresh authorization if it increases its bed capacity". Now, the HCF wants to use 9 no. of beds already installed in the hospital and accordingly, has applied for obtaining fresh authorization under the Bio-Medical Waste Management Rules, 2016 alongwith requisite documents for 9 beds capacity. In regards to bed capacity the HCF has submitted an undertaking, which is reproduced as under: Further, the Board vide its office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023, has notified authorization fee for HCFs. In this case, the HCF falls in the category of 11-30 beds capacity and accordingly, the HCF had already deposited authorization fee of Rs. 4,000/- vide UTR no. HS92315204340927 dated 01/06/2023 and now, Rs. 2,000/- has been deposited vide UTR no. N185243127718912 dated 03.07.2024 under the provisions of BMW Rules, 2016 in previous incomplete application, which is valid up to 31/12/2026. The brief detail of the case applied by the healthcare facility is as under: - 1. The HCF has made revised agreement with M/s Medicare Environment Management Pvt. Ltd., Ludhiana which is valid upto 10.07.2027 for 9 bedded capacity. 2. Completion certificate regarding ETP of capacity 15 KLD. 3. The HCF has submitted copy of manifests of lifting of waste by CBWTF operators. 4. Undertaking regarding the bed capacity. 5. The HCF has submitted annual return in Form-IV. Accordingly, the HCF was visited by the undersigned on 12.07.2024 and during visit, it was observed as under: 1. The HCF is a 9 bedded hospital and was found in operation alongwith its ETP. 2. The record of bio-medical waste lifting manifest is being maintained. 3. Needle Shredder has been provided on necessary points. 4. Color coded containers are provided for storage of bio medical waste. 5. Segregation of bio medical waste is being done properly. 6. The bio medical waste is being lifted regularly by CBWTF. 7. Non-chlorinated bags are used for storage of bio medical waste. 8. Bar code stickers are used for color coded bags. 9. The HCF has provided bio medical waste storage room for storage of biomedical waste. 10. The HCF has stored expired medicines separately in yellow bag. The HCF is found complying with the provisions of BMW Rules, 2016. As per Board's office order no. 329 dated 14.09.2023, which is reproduced as under: As per the latest Office Order of the Board vide no. 379 dated 27/10/2023, “it has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-Medical Waste Management Rules, 2016 as amended upto date and subsequent amendments, if any.” In the present case, the HCF is located in city Sunam, where the terminal STP has already been installed and the same is in operation. Further, the HCF has already operating its hospital alongwith its ETP. In light of above office orders, the HCF is found complying with all the provisions of BMW Rules, 2016. As per record of this office, no action is pending against the health care facility for violation of the Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and Environment (Protection) Act, 1986. Keeping in view of above, if approved, the HCF may be granted authorization upto 30.06.2024 under Bio-Medical Waste Management Rules, 2016 with suitable conditions and with special conditions that: 1. This BMW authorization is valid to operate its 7 no. of Beds only. HCF shall apply for fresh authorization, if it is required to operate more no. of beds, already installed. 2. The action as per the BMW rules will be taken against the HCF, in case of non-compliance of the special condition no. 1 and the undertaking submitted by the HCF. 3. The HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-Medical Waste Management Rules, 2016 as amended upto date and subsequent amendments, if any. 4. The HCF will apply for consents of the Board under Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and under Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987. 5. The HCF will comply with the provisions of BMW Rules, 2016 in true letter & spirit. 6. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same. 7. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year. 8. The HCF will maintain proper record of generation and lifting of bio-medical waste. 9. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
