RO has reported that the authorization under Bio- Medical Waste (Management and Handling) Rules, 2016 was granted online reference no. BMW/Renewal/PKT/2023/23334858 dated 05/10/2023, which is valid upto 30/09/2024 for 350 beds through OCMMS. The HCF has applied for obtaining renewal of authorization under Bio Medical Waste Rules, 2016 for 350 beds. The HCF has done agreement with the Common Bio Medical Waste Facility for 350 beds for treatment and disposal. The HCF was visited by the AEE on 28/06/2024 and it was observed as under:- 1. The HCF is having 350 beds in the premises, but there was very less occupancy. 2. The HCF has provided colour coded plastic bins at wards, operation theatre, ICU, and Nursing Stations for segregation of Bio Medical Waste and segregation was found as per Bio Medical Waste Management Rules, 2016. 3. The HCF has provided needle destroyers for shredding of needles. 4. The HCF has provided a final collection point for Bio Medical Waste and no mixing of Bio Medical Waste was found during visit. 5. The HCF is maintaining the record of Bio Medical Waste lifted to CBWTF. 6. The institute has provided STP for the treatment of the entire effluent generated from the premises. During visit, sufficient quantity of raw effluent was not available due to less occupancy. It is pertinent to mention here that the HCF is a having built-up area more than 20,000 sq.mts and as per the EIA Notification, 2006, such projects needs to obtain prior Environmental Clearance from the competent authority before starting its construction activity. The HCF was commissioned without obtaining Environmental Clearance under EIA Notification, 2006. The Board has filed Criminal Case against the said HCF cum Medical College under the provisions of the EPA Act, 1986 for violating the provisions of the EIA Notification, 2006 in the court of Hon’ble CJM, Pathankot, which is pending in the court of law. It is submitted as per the orders of the competent authority of the Board, the area of the HCF in excess to the 20,000 sq.mts was sealed by the officers of the Board during visit on 01/08/2023 and thereafter, the unit was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with one of the special condition that the project proponent shall not operate the sealed area without obtaining Environment Clearance and permission of the Board. RO has recommended that authorization under Bio- Medical Waste (Management and Handling) Rules, 2016 may be extended upto 30/09/2025 with the special condition that the validity of consent to operate/authorization will depend upon the outcome of the court case pending in the Hon’ble CJM Court, Pathankot as well as decision of the SEIAA in the said matter w.r.t Environment Clearance.
EE ZO has observed that Hospital has submitted agreement in the name of M/s White Medical College but applied under the name & style of M/s Chintpurni medical College without mentioning the expiry date of agreement, not submitted verified compliance of authorization conditions, not submitted category wise generation of bio medical waste and not mentioned about the authorization fee to process the application. May if approved, the case be sent to RO to reply all points mentioned by Zonal Office within 01-day so that case may be sent to CA to avoid deemed approval of the same. as above or other appropriate action.
In reply to the observation raised RO submitted pointwise reply is as under:-
1. M/s CHINTPURNI SCHOOL EDUCATIONAL SOCIETY and the hospital component is having trade name M/s THE WHITE MEDICAL COLLEGE & HOSPITAL. The copy of the GST Certificate is attached herewith. The unit has done agreement as per the trade name i.e. M/s THE WHITE MEDICAL COLLEGE & HOSPITAL for the hospital component only. However, the Medical College Cum Hospital is registered as per Chintpurni Medical College & Hospital in the OCMMS. Further, the previous CTO and Authorization has also been granted on the same pattern. 2. The compliance of authorization conditions have been submitted by the hospital in annotated form which have been verified. 3. The details of the quantity of different BMW categories viz a viz generation has been mentioned in the agenda note attached on 01.07.2024.(Also reattached for kind perusal) 4. The authorization fees details are also attached in the agenda note attached dt 01.07.2024. The HCF has deposited Rs. 20,000/- vide UTR No. N177243110740165 dated 25/07/2024 (as telephonically asked from EE RO Batala the date is 25/06/2024) which is adequate for one year period.

In view of above, it is recommended that authorization under Bio- Medical Waste (Management and Handling) Rules, 2016 may be extended upto 30/09/2025 with the special condition that the validity of consent to operate/authorization will depend upon the outcome of the court case pending in the Hon’ble CJM Court, Pathankot as well as decision of the SEIAA in the said matter w.r.t Environment Clearance.
