File Note: Agenda note attached. It is submitted that earlier the industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2019/10203214 dated 07.08.2019 which was valid upto 30.06.2024 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/SAS/2019/10245137 dated 30.08.2019 which was valid upto 30.06.2024 for manufacturing of RECLAIMED RUBBER @ 9 MTD by using raw material as Old Tyres Rubber Scrap @ 09 TPD, Fillers @ 0.20 TPD, Petroleum based Oils @ 0.15 TPD subject to certain terms and conditions mentioned therein. Thereafter, the industry has obtained auto renewal consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/SAS/2024/25069387 dated 27.06.2024 which is valid upto 27.06.2029 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTO/Renewal/SAS/2024/25069364 dated 27.06.2024 which is valid upto 27.06.2029 subject to suitable terms and conditions mentioned therein. Now, the industry has applied for obtaining fresh authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for Generation, Collection, Storage & Disposal of hazardous waste cat. 5.1 @ 0.01 KL/Annum, 5.2 @ 0.024 T/Annum, 35.3 @ 0.780 T/annum alongwith requisite documents. The site of the industry was visited by the undersigned on 11.07.2024. During the visit, it was observed as under: 1. The industry was in operation. 2. The industry is generated hazardous wastes of category 5.1 - Used Oil, 5.2 - Waste or residues containing oil & 35.3 - Chemical sludge from wastewater treatment. 3. The industry has provided common storage rooms for storage of hazardous wastes about size 8’ x 10’ and with lock and key facility. 4. The industry has provided danger signs at the gates of hazardous waste storage rooms/ sheds. 5. During visit, it was observed that hazardous waste of category 5.1 ~ 1 ltr is being stored in plastic can, of category 5.2 ~ 25 kg was being stored in bags and hazardous waste category 35.3 ~ 215 kg is being stored in HDPE bags at common hazardous waste storage room. 6. The industry has executed agreements for disposal of hazardous waste with different agencies, detail of the same are given as under: Sr. no. In view of the above, may if approved, it is recommended that authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 may be renewed for five years subject to suitable conditions: 1. The industry shall ensure regular lifting of hazardous waste and also ensure that the quantity of hazardous waste generated per year shall not be stored beyond 90 days (extendable upto 180 days) in its premises at any time. 2. The industry shall handle the hazardous waste(s) strictly in accordance with the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board / Ministry of Environment & Forests and Climate Change, New Delhi. 3. In case the industry fails to comply with the above conditions of authorization as well as provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and/ or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, the Board shall constrained to take action against the industry under the provisions of the Pollution Control Laws. 4. The industry shall ensure that Hazardous waste shall be stored and disposed off in scientific manner. Competency: Senior Environmental Engineer of the Board. (Deemed approval: 01.08.2024)
