It is submitted that the industry is a small-scale red category industry. The industry was granted Consent to Operate under the Water Act, 1974 and Air Act, 1981, which are valid upto 31.03.2025.
Earlier the industry was visited by the officer of this office on 23.05.2023 and it was observed that the industry was found burning stacks of paint booth having paint residue in the open on the main street resulting in air pollution. The representative informed that they were cleaning the stack by burning in the open and the industry has installed one hot dip brazing furnaces and one de-brazing furnace having hood and adequate stacks attached and was not in operation during visit. The industry has not provided proper sampling arrangement for collection of stack emission sample.
Thereafter the industry was issued notice u/s 31-A of the Air Act, 1981 as amended in 1987 alongwith show cause notice for violation under the provisions of HWM Rules, 2016 with opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 17.07.2023, wherein it was decided as under: -
1. The industry was advised not to repeat the violations in future.
2. It was made clear to the industry to be careful in future and if the industry was found causing air pollution in future, strict action may be taken against the industry, without any further notice/opportunity of hearing
3. The industry shall submit bank guarantee of Rs. 50,000/- as an assurance to comply with the provisions of Air (Prevention & Control of Pollution) Act, 1981, within 07 days.
4. The industry shall apply for authorization under Hazardous and Other Wastes (Management and Trans boundary Movement) Rules, 2016, within 7 days.
5. Environmental Engineer, Regional office shall submit his report and conclusion recommendations after 15 days alongwith processing application on merit.
The point wise compliance of above is attached herewith.
Now, the industry has applied for fresh authorization under HWM Rules, 2016 for generation, collection, storage & disposal of hazardous waste of category 5.1 (Used or spent oil) @ 0.080 KL/Annum, category 21.1 (Paint Sludge) @ 1.80 TPA and category 33.1 (Empty Containers) @ 200 Numbers/annum.
The industry was visited by the officer of this office on 11.07.2024 and it was observed as under: -
1. The industry was in operation during the visit and is engaged in manufacturing of Bicycles frame and Bicycles fork.
2. The industry is engaged in process of Acid dip (H2SO4) and phosphating. The industry is maintaining the record and was found in consonance with the water meters installed and effluent lifted to CETP operator.
3. The industry is generating hazardous waste of category 5.1, 21.1 and 33.1.
4. The industry has one DG set of 50 KVA with canopy and adequate stack height.
5. The industry has made storage room for storing of category 5.1 waste i.e. spent oil, 21.1 waste i.e. paint sludge and 33.1 waste i.e. empty containers.
6. The industry has made an agreement with M/s Satkar Oil Company, D-177, Phase-6, Focal Point, Ludhiana for lifting of category 5.1.
7. The industry has lastly lifted 40 ltrs. used oil, category 5.1 to authorized recycler (M/s Satkar Oil Company, D-177, Phase-6, Focal Point, Ludhiana) on 07.07.2024 vide manifest no. 138/24-25.
8. The industries has installed 6 no. paint booths and all were with water curtain as APCD.
9. The industry has made an agreement with M/s Nimbua Greenfield, Village Nimbua, Tehsil Derabassi, SAS Nagar for lifting of category 21.1 (Process wastes, residues and sludges) and category 33.1 (Empty Containers). Currently 326 Kgs of paint sludge was found stored in 9 number of HDPE bags. The representative informed that same shall be lifted once the authorization is granted by the Board as per their deliberation with the TSDF, Nimbua.
10. The industry has made an agreement with M/s Lucky Steel Works, 71-72, Industrial Area-B, Ludhiana for lifting of category 33.1 i.e. empty containers. Currently 177 number of empty containers was found stored.
11. The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and HWM Rules, 2016.
12. The industry has been visited three times i.e. on 23.09.2023, 21.03.2024 and 11.07.2024 and no violation has been observed w.r.t water, air and HW pollution.
In view of the above, it is recommended that the authorization for generation, collection, storage & disposal of hazardous waste of category 5.1 (Used or spent oil) @ 0.080 KL/Annum, category 21.1 (Paint Sludge) @ 1.80 TPA and category 33.1 (Empty Containers) @ 200 Numbers/annum may be granted to the industry for five years with suitable conditions as per policy of the Board.
