File Note:  It is submitted that the PHC has applied for fresh authorization under the Bio-Medical Waste Management Rules, 2016 through OCMMS for generation, segregation, collection, disposal of bio-medical waste of category yellow, red, blue & white generated from OPD only. The details of the case are as under – • The PHC has submitted an undertaking through Dr. Jaspreet Singh, stating that the HCF is clinic (OPD) and is treating its liquid waste generated from the HCF using sodium hypochlorite solution and further has given assurance that it shall always comply with the effluent standards as Prescribed by MOEF for discharging of Hospital effluent. • The PHC has deposited authorization fee of Rs. 1000/- vide R. No. 12/5574 dated 12.07.2024 under Bio Medical Waste Management, Rules, 2016, which is adequate. • The PHC has submitted copy of an agreement with common facility of M/s Med Waste Solutions Pvt. Ltd., authorized by the Board with validity upto 01.01.2026 for OPD only. • The PHC has submitted copy of location plan.  The Board vide letter no. EPA/2018/No. 1 dt. 03.01.2018 has decided that if the Health Care Facility is non-bedded, it will be granted one-time authorization under BMW Rules, 2016 with the condition that the HCF will apply for fresh authorization if it becomes a bedded hospital.  The Board vide its office letter no. EPA/2018/no.-04 dated 10.04.2018 in order to ensure ease of doing business in the small HCF in the state of Punjab has mandated that the authorization (fresh / renewal) under the BMW Rules, 2016 applied by the HCF up to 20 beds / dental chairs will be granted by the concerned Regional Office within 7 days on receipt of complete application without making inspection of those HCFs. However, the concerned Regional Office shall ensure that no action is pending against the concerned HCF for violation of the BMW Rules, 2016, Water Act, 1974, Air Act, 1981, Environment Protection Act, 1986 and various rules made there under. After grant of authorization, randomly selected 10% HCFs shall be visited by the Regional Office within next 3 months to check compliance the provisions of BMW Rules, 2016.  In 4th core committee meeting taken by the Hon’ble Chairman of the Board on 31.10.2018 in the committee room, Head Office, Patiala it was decided that for nonbedded HCFs, the authorization under Bio-Medical Waste Management Rules, 2016 may be granted one-time. Non-bedded HCFs have to provide pre-treatment of liquid waste with 1-2 % sodium hypochlorite solution only. Above said decisions were conveyed by EPA cell vide letter no EPA/2019/No. 670-83 dated 14.03.2019.  As per the office order no. EPA/2017/No. 5261-86 dated 15/12/2017 the competency of upto 50 beds HCEs and Labs and Blood Banks, Pathological Lab, Veterinary Institutions / Animal House etc lies with the Environmental Engineer of the Regional Office's. Keeping above in view, it is recommended that one time authorization under Bio-Medical Waste Management Rules, 2016 may be granted to the HCF with suitable conditions and specific conditions as under: - 1. The HCF shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio Medical Waste Management, Rules, 2016 as amended upto date and subsequent amendments if any. 2. The doctor incharge of PHC shall ensure segregation of the bio medical waste and keep proper record regarding daily generation and disposal of bio medical waste category wise as per schedule-I of the Bio Medical Waste Management Rules, 2016. 3. This authorization is valid till PHC remains a non-bedded / OPD facility. The PHC will apply for fresh authorization if it becomes a bedded. 4. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis. 5. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
