Subject: Proceedings of the personal hearing given to M/s Jindal Agencies, Gurusar Sehnewala, Distt. Bathinda before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 as well as authorization under the provisions of HOWM Rules, 2016 by the Chief Environmental Engineer (B) of the Board on 15.07.2024..............

It was brought out that the industry has installed induction furnace of capacity 300 kg/heat & 150 kg/heat alongwith galvanizing furnace and shot blasting machine..............
The industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 dated 23.09.2021 (valid upto 30.06.2024)..............
Authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 was granted to the industry with validity upto 30.06.2021.............
The industry has now applied for obtaining consents to operate under Water Act, 1974 & Air Act, 1981 as well as authorization under the HOWM Rules, 2016 alongwith an agreement executed with the CETP Electroplating Ludhiana on 28.4.2023 (valid upto 31.05.2025) for lifting & treatment of effluent @ 600 ltr/month..................
The industry was visited by officer of the Board on 21.06.2024 and it was observed that:-.............
1. The industry has lifted its effluent generated from the hot dip galvanizing furnace to the CETP, Ludhiana and the effluent was lastly lifted on 30.12.2023 and no effluent has thereafter been lifted to the CETP..............
2. The industry has not submitted any record regarding HCL Spent acid generated from utilization of zinc dross.............
The industry has not installed its individual ETP to treat effluent generated from its process and the lifting by CETP Ludhiana does not seems to be feasible................
Show cause notice before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 as well as authorization under the provisions of HOWM Rules, 2016 has been issued to the industry alongwith an opportunity of personal hearing before the Chief Environmental Engineer (B) on 15.07.2024..............
During hearing, the Prop.of the industry submitted written reply to the notice issued, which has been taken on record. He further submitted that we have decided to close up the zinc plant installed with the premises and requested to grant CTOs under the Water Act, 1974 & Air Act, 1981...............
After hearing the manger the industry and officer of the Board, the Chief Environmental Engineer (B) decided that:-.............
1. The present applications applied by the industry under Water Act, 1974 & Air Act, 1981 for operation of induction furnace, galvanizing furnace & shot blasting machine be returned with the request to re-apply for obtaining consents to operate under the said Acts, for the processes which are to be operated by the industry...........
2. The industry will not operate its zinc plant/galvanizing furnace without obtaining consents to operate of the Board as required under the provisions of the Water Act, 1974 & Air Act, 1981.............
3. Environmental Engineer, Regional Office, Bathinda shall visit the industry, process the applications to be applied under the Water Act, 1974 & Air Act, 1981, on merits..................
Submitted for confirmation of the decisions of the personal hearing dated 15.07.2024..........
If approved, the application applied by the industry for obtaining authorization under the HOWM Rules, 2016 be also returned with the request to re-apply the same for the categories which are to be generated from the processes to be operated by the industry.
